SUBJECT: NRC INTEGRATED INSPECTION REPORT 50-309/96-14 I

(NOTICE OF VIOLATION)

Dear Mr. Sellman:

On January 25,1997, the NRC completed an inspection at your Maine Yansee reactor l

!

facility. The results of that inspection were discussed with Messrs. R. Blackmore,  :

J. Frothingham and others of your staff at an exit meting held on February 10,1997. The {

enclosed report presents the results of that inspection.

During the 7-week period covered by this inspection period, your conduct of activities at

the Maine Yankee facilities was safety focused. The plant was maintained safely,

following the shutdown to address cable separation issues. The decision to perform the

fuelinspections during the current outage was en example of conservative decision making j

by Maine Yankee. i

As a result of this inspection, we noted your efforts to effect overall performance

improvements in the radiological controls program. Noteworthy endeavors were to i

improve work coordination, address cultural issues, and develop a comprehensive problem l

identification and resolution program. However substantial program performance  !

improvement remain. Weaknesses in the contamination control program persist. As noted )

below, our inspectors identified a violation in the area of contamination control. Further,

our review and your own investigation of unscheduled gaseous releases appeared l

hampered by the lack of a clear designation of responsibility and accountability (ownership)

for the revieve and summary of program performance issues related to unscheduled

gaseous releases. 1

We received your correspondence dated January 31,1997, which provided a clarification

of Event Review Board (ERB-010) " Unplanned Worker Exposure in RCP Impeller i

Decontamination Container," dated April 27,1995, that was previously submitted to the l

NRC. Our review of this issue is in Section R8.5 of this report.

The security program was reviewed during this period and found to be effectively /

,

implemented to protect public health and safety. [l ,

Further two violations were identified during this inspection. The continued use of the

spent fuel pool crane to move irradiated fuel without assessing or correcting recurring

problems is a violation of technical specifications. Also, there was a failure to follow  ;

radiological control procedures upon exiting a contaminated area. The violations are cited l

in the enclosed Notice of Violation, and the circumstances surrounding the violations are i

described in detail in the enclosed report. Please note that you are required to respond to '

this letter and should follow the instructions specified in the enclosed Notice when

preparing your response The NRC will use your response, in part, to determine whether ,

further enforcement action is necessary to ensure compliance with regulatory '

requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter ,

and its enclosure will be placed in the NRC Public Document Room. '
