Dear Mr.'Elliott:
We have ' received your proposed Stipulation regarding arrangements by Philadelphia Electric Company? ("PECO") for the handling and treatment of any-onsite-contaminated injured-individuals at a backup hospital. ;We have-reviewed it and discussed it with counsel for. the NRC Staff and Commonwealth of Pennsylvania.
Your proposed Stipulation recites that Limerick Ecology
' Action -(" LEA") is satisfied with' the arrangements made by.
PECO with' Montgomery Hospital 1 based, upon _ (1) ~ LEA's review of the ' November;.15, 1985. letter. of-agreement from Montgomery Hospital;
.-(2) the draf t, procedures, ' list of ' specialized equipment, and. Plan of instruction for ' medical' staff-regarding. admission and treatment of-contaminated ' injured individuals;' and (3). your telephone. conference with Mr.
Robert Hood, Montgomery Hospital, Administrator of Ancillary Services.
Pursuant to Ithe.
Licensing Board's earlier request, we are enclosing a copy of Mr. Boyer's affidavit'of.
January 2,. 1986, which - confirms the verbal understanding reached between-PECO'and. Montgomery Hospital and previously:
recited in the November.15, 1985 letter of agreement.

Page 2 We agree in principle with the position taken in your proposed Stipulation, but we believe that LEA should take the last. logical step by withdrawing its contention.
Because, as you represent, LEA is truly satisfied with the arrangements which have been made, it is an imposition upon the Licensing Board to ask it to make formal findings in yet another partial initial decision in order to dispose of this final matter.
Accordingly, we suggest that the last paragraph of the Stipulation be worded somewhat as follows:
In view of the satisfactory arrangements now in place for the handling and treatment of any onsite contaminated injured individuals, as set forth above, LEA hereby withdraws its contention.
The other parties to this Stipulation concur in this action.
Lastly, we note that counsel for the NRC Staff and the Commonwealth of Pennsylvania as parties in interest should also appear on'the signature page of the Stipulation.
I have discussed these matters with Mr. Rutberg of the NRC Staff and Miss Ferkin for the Commonwealth of Pennsylvania, who have authorized me to state that they would be willing to sign your proposed stipulation if it contains our recommended change.
