l. Proposed technical specification (TS) 6.51. The NRC staff has compared the wording of your proposed TSs with the wording of the medical use licenses of the medical centers that can refer patients to MIT for boron-neutron capture therapy (BNCT). To have the wording of the MIT TS reflect the conditions of the medical use licenses we propose MIT consider wording similar to the following:

Patients accepted for treatment shall have been referred by written directive from a BNCT physician authorized user from a medical center with an NRC or Agreement State medical use license that contains BNCT specific conditions and commitirmts for BNCT treatments on humans conducted at the Massachusetts Institute of Technology Research Reactor Medical Therapy Facility.

Wording similar to this should also be considered for your proposed TS basis, and although not part of the TS, sections 2 and 3(a) of your quality management program (QMP).

2. To make it clear that the physician authorized user providing the written directive to MIT is a physician with a background in BNCT, please consider adding "BNCT" to the phrase " physician authorized user" whenever it appears in the TSs. Also, to reflect the wording used in the medical use license we propose that MIT consider wording for definition 12 similar to the following:

The term 'BNCT physician authorized user' means a medical physician authorized by the medical use licensee's radiation safety committee to act as an authorized user for BNCT on humans.

Although not part of the TSs, please consider similar changes to your QMP.

Definition 9(a) of the QMP is similar to definition 12 of the TS.
