This is in response to your letters dated June 6, August 30 (two letters),

September 6, September 16, September 20, October 2, November 19, December 5, December 17, and December 18, 1985 (your reference #'s 696-7065, 696-8005, 696-8006, 696-8011, 696-8014, 696-8017, 696-8026, 696-8039, 696-8050, 696-8053 and 696-8054 respectively). The subjects of the above mentioned letters per-tain to four interrelated matters, namely:

(a) a proposed reorganization structure in connection with a reduction in staff and operations; (b) submittal of, and revisions to, your " Category I Shutdown Facility Physical Protection Plan";

(c) a request for approval to initiate fuel fabrication operations associated with the North Warning System; and (d) revisions to your " Fundamental Nuclear Material Control Plan".

It should be noted that certain elements of items (b) and (d) above were submitted at our request to clarify some of the issues pertaining to items (a) and (c), and their content was based on discussions held between GA and NRC staff personnel. It should be further noted that the proposed reorganiza-

tion was modified, with mutual consent, by item (d).

We have completed our review of all the submittals referenced above, and are granting approval for your requests pertaining to items (b), (c) and (d).

We have determined that the granting of the requests will not adversely affect the common defense and security nor the public health and safety, and is otherwise in the public interest. Accordingly, we are revising License Conditions 2.1 and 9.1.A of Amendment SG-1 to your License No. SNM-696, and issuing new Condition 2.4 to the same amendment, effective immediately, to read as follows:

2.1 The licensee shall tollow Revision A of its Fundamental Nuclear Material Control Plan, dated October 1982; as revised by submittals dated January 25, 1985 (pages 2-1, 2-4, 2-5, 5-2, 5-3, 6-3, and figures 2.1.1-1 and 2.1.1-2 --- all dated " January 1985"), another 8601140151 851219 PDR ADOCK 07000734 C PDR

GA Technologies January 25, 1985 submittal (pages 7-6 through 7-20 --- all dated

" February 1985"), and December 5,1985 (pages 1-1 through 1-10, 4-1 through 4-3, 8-1 through 8-4, and figure 1-1 --- all dated December 1985); and as may be revised in accordance with the provisions of 10 CFR 70.32(c).

2.4 During the HEU shutdown period for HTGR fuel manufacturing (Plant I),

production of LEU fuel (having a maximum U-235 enrichment of 19.99%)

for the North Warning System project may be conducted in accordance with the Material Control Plan submitted as an attachment to the Licensee's letter dated September 16, 1985 (Ref. #696-8014), provided such production is limited to processing activities within the SVA and SVB buildings and that the quantity of LEU material does not exceed the Category III limit, as defined by 10 CFR 73.2(y)(2),

within each of the two said buildings.

9.1.A The licensee shall follow the security plan titled " Category I Shutdown Facility Physical Protection Plan," dated May 1985; as revised by sub-mittals dated September 6,1985 (pages 19-2 and 19-3; IRS's 14-3, 75-1, 84-2, 84-3; and Figures IRS 10-4 and IRS 56-4), November 19, 1985 (pages 18-1 through 18-4, 18-9, 22-1 through 22-14; IRS 1-1 and 56-2),

December 17, 1985 (pages 22-6 and 25-1), and December 18,1985(pages 18-9 and 22-12);and as may be revised pursuant to the provisions of 10 CFR 70.32(e).

a We have detennined that the enclosures and attachments to the eleven letters referenced in the first paragraph of this letter all contain information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1),

such information is deemed to be commercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld from public disclosure unless subject to the provision of 10 CFR 9.12. Additionally, we have determined that the security -

plan identified in Condition 9.1.A and submitted under your cover letter (696-7065) dated June 6,1985, as well as the enclosure to your letter (696-8011) dated September 6,1985 both contain classified (C0kFIDENTIAL NATIONAL SECURITY) infonnation and will be protected accordingly. The security plan and all sub-mitted revisions thereto also contain Safeguards Information which is required to be protected against unauthorized disclosure in accordance with 10 CFR 73.21.
