NOTICE OF VIOLATION Westinghouse Electric Corporation Docket No. 70-1151 Columbia, South Carolina License No.1107 During an NRC inspection conducted on February 10-14,1997, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and i Procedures for NRC Enforcement Actions," NUREG-1600, the violation is listed below: )

1 Safety Condition S-1 of License 1107 authorizes the use of licensed materials in accordance with the statements, representations, and conditions in the License Application and Supplements.

Section 3.4.1 of the NRC approved license application defines Category-1 procedures as procedures for use by the Regulatory Component that are also prepared by the Regulatory Component. Additionally, this section defines Category-2 procedures as procedures for use by individuals outside of the Regulatory Component but are still prepared by the Regulatory Component. Columbia Fuel Fabrication Facility (CFFF)

Emergency Procedures are written and prepared for issuance by the Regulatory Component and they are either used by the Regulatory Component or by individuals outside the Regulatory Component, depending on the specific procedure. Additionally, the license application states that both Category-1 and Category-2 procedures will be reviewed and approved for issuing by the cognizant Regulatory Component Manager.

Contrary to the above, as of February 14, 1997, Emergency Procedures issued by the licensee were not approved by cognizant Regulatory Component Manager until after they had been issued and implemented.  ;

This is a Severity Level IV violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, Westinghouse Electric Corporation is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with copies to the Regional Administrator, Region II, and Chief, Fuel Cycle Operations Branch, Division of Fuel Cycle Safety and Safeguards, NMSS, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if Enclosure  !
