1. Convention. Hugh Thompson, EDO, Chair of the Management Review Board j (MRB), convened the meeting at 9
30 a.m. Introductions of the attendees

! were conducted.

Old Business. Approval of the July 17, 1996 Kentucky MRB Minutes.

2. The
first order of business concerned the MRB meeting held on July 17, 1996.

i Draft minutes, as circulated on July 25, 1996, were approved with one

{ change to clarify the MRB consensus that Kentucky does not need to adopt l a rule equivalent to the 10 CFR Part 61 amendment effective July 22, 1993 (concerning the definition of land disposal and the waste site QA program).

3. New Business. Iowa Review Introduction. Mrs. Kathleen Schneider, OSP, led the Integrated Materials Performance Evaluation Program (IMPEP) team
for the Iowa review.

1 l Mrs. Schneider discussed how the review was conducted. Preliminary work j included review of Iowas response to the IMPEP questionnaire. The i- onsite review was conducted April 1-4, 1996. The onsite review included an entrance interview, detailed audits of a representative sample of licensing and inspection files, and follow up discussions with staff and

! management. The onsite portion of the review concluded with exit briefings with Department of Public Health management. Following the

review, the team issued a draft report on May 8, 1996; received Iowas comments dated May 22, 1996; and submitted a proposed final report to
the MRB on July 19, 1996.
Status of Items Identified in Previous Reviews. Mrs. Schneider discussed
the status of the recommendations made during the 1993 routine review

, and the 1994 review visit. She noted that one recommendation on two j specific licenses was considered open during preparation of the draft i

A report, but is now closed based on guidance given in past MRB meetings to carry forward from pre-IMPEP reviews only those comments that raise perfonnance concerns.

Coasson Performance Indicators. Mrs. Schneider presented the team findings for the first common performance indicator - Status of the Materials Inspection Program. Her presentation corresponded to Section 3.1 of the IMPEP report. The team recommended that Iowas performance be found " satisfactory," with four recommendations for this indicator.

Following discussion and questions from the MRB members, the Board reached consensus that Iowas performance met the standard for a

" satisfactory" rating for this indicator.

Mrs. Schneider also discussed the second performance indicator -

Technical Staffing and Training. Her presentation corresponded to Section 3.2 of the IMPEP report. Mrs. Schneider concluded that the team recommended that Iowas performance be found " satisfactory" with one recommendation for this indicator. The Board discussed the teams recommendation and concurred that it should be deleted. Mr. Bailey raised a question regarding whether the IMPEP teams should solicit specific comments from the States about the impact of the discontinuance of NRC funding for travel and training. The other Board members felt that the information is captured through the current evaluation process, and that specifically addressing the issue was not needed at this time. The MRB concurred that Iowas performance met the standard for a " satisfactory" rating for this indicator.

Mr. Frazee discussed the indicator - Technical Quality of Licensing Actions. He summarized findings in Section 3.3 of the report, which found Iowa's licensing actions to be generally thorough, complete, consistent, and of acceptable quality with health and safety issues properly addressed. The IMPEP team recommended that Iowas performance be found " satisfactory" for this indicator. The Board asked questions about a statement in the draft report that the there was no apparent procedure for terminating licenses, but no recommendation on this was offered. Mr. Frazee explained that some inconsistencies were noted in the first three terminated license files reviewed, however, a further review of four additional terminated license files did not find further inconsistencies. The team concluded that there was no programmatic problem. Following this discussion, the MRB concurred that Iowa's performance met the standard for a " satisfactory" rating.

Mr. White discussed the indicator - Technical Quality of Inspections, which summarized Section 3.4 of the report. The team recommended that Iowas performance on this indicator be found " satisfactory," with four recommendations. The MRB asked for a clarification of the statement in the draft report about inspectors performing independent measurements, and discussed the need for a separate form for inspecting high dose rate after loader brachytherapy facilities. Following this discussion, the MRB reached consensus that Iowas performance met the standard for a

" satisfactory" rating for this indicator.

, . The final common performance indicator assessed Iowas response to i incidents and allegations. Mrs. Schneider led the discussion in this

! area. As addressed in Section 3.5 of the report, the team recomended that Iowa's performance relative to this indicator be found i " satisfactory" and with one recommendation. Mrs. Schneider noted that,

. .in accordance with past MRB direction, the report will be revised to

, show that Iowas incident files had been reviewed against a printout

- from the Nuclear Materials Events Database. Following this ,

presentation, the MRB reached consensus that Iowas performance met the standard for a'" satisfactory" rating for this indicator.

Non-common Performance Indicators. Mrs. Schneider led the discussion of i the non-common indicator on Legislation and Regulatiens, which l sumarized Section 4.1 of the report. She notd that the team ~

recommended a finding of " satisfactory." % MRB reached consensus that Iowas performance met the standard for a " satisfactory" rating.
4. MR8 Consultation / Comments on Issuance of report. Mrs. Schneider
j. concluded, based on the discussion and direction of the MRB, with a

, recommendation that Iowas program be found satisfactory in all comon i performance indicators and the non-common indicator and that the be found program adequate to protect public health and safety and  :

! compatible with NRC's regulatory program. She recomended that Iowa be i' scheduled for its next IMPEP review in approximately 3 years, considering the history of the program in prior reviews. The MRB

! concurred in these recomendations.

6. Comments from the State of Iowa. Mr. Flater indicated that Iowa has j taken action in response to the draft report. All items have been i

addressed, and while recomendations in some areas were not accepted,

! the rational for the States action was given. Copies of the response were provided to the team and the Board members. He expressed support 4 for the IMPEP process, and felt it was helpful to the program. There i was good interaction between the team and his staff. He comended all 4 members, and noted especially the importance of the team leader. He

! suggested that there was a need for contact between NRC and the States  ;

! more frequently than every four years. '

i e 7. Status of Remaining Reviews. Mrs. Schneider reported on the status of i scheduled future IMPEP reviews and reports. New status charts were distributed, i 8. Adjournment. The meeting was adjourned at approximately 10:45 am.
