ORDER IMPOSING CIVIL MONETARY PENALTY - $50,000

Dear Mr. Kingsley:

This refers to your letter dated December 19, 1996, in response to the Notice l

of Violation and Proposed Imposition of Civil Penalty (Notice) sent to you by '

our letter dated November 19, 1996. Our letter ar.d Notic: described four violations of NRC requirements identified during an inspection conducted during the period luly 8 through August 22, 1996, at your Sequoyah Nuclear Plant. The results of tha inspection were originally documented in Inspection Report Nos. 50-327 anc 59 328/96-10 issued on September 27, 1996.

To emphasize the importance of management attantion to, and oversight of, fire protection activities, as well as the need M prompt corrective actions, a l Severity Level III problem and a civil penaity of $50,000 was proposed in the Novemhr 19, 1996 letter. .

In your response, you agreed that the violations occurred; however, you n;aintained that the NRC's categorization of the violations at Severity Level III with a proposed civil penalty of $50,000 was inconsistent with the Enforcement Policy. You requested that the NRC reconsider the severity level of the violations and mitigate the associated civil penalty in its entirety.

After consideration of your response, we have concluded, for the reasons given j in the Appendix attached to the enclosed Order Imposing Civil Monetary Penalty, that the violations, the severity level, and civil penalty associa:ad with the Severity Level III problem should stand as proposed, four response <

focused on the safety and regulatory significance of each of the violations

taken individually, as well as the actions you have implemented in recent years in the area of fire protection. However, the bases for citing the j 4' violations collectively as a Severity Level III problem was the significant lack of attention and priority given to your fire protection program. In  !

addition, the actior was based on the significance of the violations taken  ;

collectively, not ir.cividually. Whi the NRC acknowledges some progress in  !

improving the fire protection prograt at Sequoyah, the continuing lack of i timely resolution of long-standing issues in the fire protection area j indicates your actions have not been fully effective. Accordingly, we hereby  ;

We will review the effectiveness of your corrective actions during subsequent inspections.

In accordance with 10 CFR 2.790 of the N?s " Rules of Practice," a copy of this letter and the enclosure will be placed in the NRC's Public Document Rosa.
