MAINE YANKEE LETTER OF DECEMBER 10,1996 IN RESPONSE TO THE INDEPENDENT SAFETY ASSESSMENT REPORT

Dear Mr. Sellman:

This letter regards your December 10 response to the independent Safety Assessment Team's (ISAT) report issued on October 7,1996. We fir'.d your response addresses, at least at a broad level, the major conclusions and concerns raised by the ISAT. As described in your letter and at the February 4,1997, meeting with the Commission, significant steps are needed to resolve both equipment and process related issues found at the Maine Yankee facility.

Some of your plans are detailed with specific timeframes established for completion of work. Plans to address a number of issues, however, such as those in the licensing and i design basis area, were not sufficiently developed for us to assess at this time. In most such areas, your response identifies later times when plan details will be provided. We note, also, that station management changes associated with the recently established Entergy Nuclear Inc., management services contract is leading to further adjustment of your improvement program plan.

Assessment of your plans and their implementation will occur through NRC's ongoing inspection and performance overview process. In this regard as you are aware, we have decided to implement the special agency process applicable to plants in a shutdown status

such as now exists at Maine Yankee (NRC Manual Chapter 0350). An Assessment Panel 1

has been established to identify those issues requiring resolution prior to plant restart and coordinate agency inspection efforts. More broadly, our assessments will require additional meetings with you to review your plans and progress. Such meetings will be open for public observation. In addition, consistent with 0350 guidelines, NRC will hold meetings with the public to solicit input on the overall process.
