MONTHLY STATUS REFORT ON EMERGENCY PREPAREDNESS Enclosed is the monthly report for November 1985 on the status of offsite emergency preparedness for operating license reviews. Offsite emergency pre-paredness issues continue to impact the licensing process for Shoreham. The Comission Decision and Start of Hearing dates shown in Table 1 of the enclosed report are consistent with the NRR monthly licensing report for November 1985.

For the other plants, the dates are those by which the NRC needs the information to act on authorization for fuel loading and low power operations.

60n April 17, 1985, the Licensing Board for emergency planning for Shoreham ruled that, although LILCO's offsite emergency plan is generally adequate, LILCO does not have the legal authority to perform many of the required emergency functions set out in that plan. On August 26, 1985, the Board issued a con-cluding partial ~ initial decision finding that because of LILCO's inability to implement its offsite emergency response plan and because of the refusal of the.

Appeals of the April and August emergency planning decisions were filed with the Appeal Board by both LILCO and the intervenors.

On October 18, 1985, the Appeal Board upheld the Licensing Board's decision that LILCO does not have the legal authority to implement its offsite emergency plan.

LILC0 has appealed this decision to the Commission.

On July 3, 1985, a license was issued authorizing operation up to 5 percent of rated power.

Resolution of the offsite emergency planning issue, including the performance of an emergency plan exercise, is required before operation above 5 percent power.

The NRC has requested that FEMA schedule as full an exercise as is feasible that would test the LILCO emergency plan including simulated response from state and local organi-zations.

Following such an exercise, additional delays may occur as a result of a possible hearing of exercise related-issues.

On the basis of the above, a realistic forecast of the impact on the licensing process cannot be made at this time.

7The ASLB has deferred hearings at the request of both the applicants and the NRC staff until the applicants can respond to several outstanding technical questions on construction and design.

The licensee has provided a current construction schedule, however, no Commission decision date has been determined.

8The Board initially admitted three contentiors relating to offsite emergency preparedness.

Hearings on these contentions began in June 1985 and the record has been closed on these contentions.

On November 5, 1985, the Board admitted two additional contentions based on the results of the full-scale exercise held in May 1985.

No schedule has been established for hearing these two newly admitted contentions.

9 FEMA has reviewed drafts of state and local plans that were submitted by New Hampshire and Massachusetts for an informal technical review.

FEMA's comments were transmitted to New Hampshire and Massachusetts for their use in preparation for formal submittal of emergency plans.

New Hampshire is expected to formally submit plans to FEMA in early December 1985.

FEMA is not able to accurately predict when Massachusetts will formally' submit plans.

Hearings on offsite emergency preparedness issues have yet to be held; the commencement of such hearings is awaiting the submission of emergency plans.
