Dear Sir or Madam:

Pursuant to Nuclear Regulatory Commission regulations contained at i 10 CFR Sec. 9, the West Michigan Environmental Action Council on behalf of itself and the Michigan Environmental Council, requests copies of the following documents under the provisions of the Freedom of Information Act, 5 U.S.C. 552:

1. All applications or other requests for authorization, by Consumers Power Company during 1985 to leave in place radioactively contaminated soil at its Big Rock Nuclear Power Plant in Charlevoix, Michigan.
2. All supporting documentation provided by Consumers Power Company, or others, in conjunction with such application or request for authorization.
3. All analysis and/or review material of the Nuclear Regulatory Commission and/or its staff concerning the subject application or request for authorization.

We respectfully request waiver of fees concerning this request pursuant to 10 CFR sec. 9.14(a)(1) and/or 9.14a(b). Our application for waiver of fees pursuant to 10 CFR sec. 914a(b) is based on our belief that furnishing this information will be in the public interest because primarily benefitting the general public. This belief is based on the . .

following:

1. The information will be used to determine the environmental impacts, if any, of the requested information. It is possible that the results of such analysis will be used in commenting before the Nuclear Regulatory Commission concerning the subject, action. It is also l

possible that such information and analysis will be provided to membership of both the West Michigan Environmental Action Council.and the Michigan Environmental Council. Publication in the Michigan Environmental Report, a periodical of the Michigan Environmental Council with a circulation of over 400 is also possible.

', , 2. The membership of the. West Michigan Environmental Council -

is approximately 500,' located pr.lmar. fly in Western Michigan.. The Michigan' Environmental Council 'is'a coalition of seventeen environinental

- organizations throughout Michigan.- The combined membership of the, Michigan-Environmental Council'is over 100,000 Michigan citizens. Both the West Michigan Environmental: Action Council and the Michigan Environmental Council are not-for-profit, private. citizens organizations.

3. It is likely that the public will benefit .from the. subject information and resulting analysis by either ' direct protection of the environment, or if the action requested by Consumers Power Company proves warranted, by the elimination and reduction of concerns and fears relative to the activity'in question.
4. No financial benefit is expected to accrue to the requesters because of this information. .
5. Both the West Michigan Environmental Action Council and the Michigan Environmental Council operate on limited budgets derived primarily

- through membership fees and contributions. Both organizations depend on information provided by government agencies as a means of. keeping their membership and the general public abreast of: environmental issues. There would be a 'resulting reduction =in the information gathering and- dissemination

. capability of both organizations'if fees for information requests to government agencies were not waived.

6. The use of the requdsted information is reasonably likely to enhance the quality of the environment because the information will be reviewed by citizens with an interest and knowledge of soil and groundwater contamination. Such review is capable of providing insights and public opinions to the Nuclear Regulatory Commission which otherwise would have been unavailable to the Commission in its consideration '

of the matter in question. In addition, dissemination of the information in the manner outlined in paragraphs 1. and.2. above will likely contribute to the general public knowledge concerning the activity and will therefore contribute to public debate on the issue.
