Dear Mr. Tilden:
This letter is in response to your memorandum to me dated May 5, 2020, that describes the Department of Energy (DOE) National Nuclear Security Administrations (NNSA) Nuclear Emergency Support Team (NEST) activities and authorities. I appreciate that DOE and U.S.
Nuclear Regulatory Commission (NRC) staff discussed the information covered by the memorandum as part of its development. We have reviewed the memorandum and find that it addresses the mutual concerns regarding DOE and DOE contractor activities conducted under the NNSAs NEST program in light of the NRC and DOE authorities under the Atomic Energy Act. We look forward to continuing to work productively with you and NNSA in the future.
