Caution should be exercised, however, to ensure that major new rules involving matters of significant public interest are brought before the Connission when the connents received 08/26/85 I-7

l suggest that the Comission might wish to reconsider certain provisions of the proposed rule, even though the staff has determined that no revisions are required. For example, for this reason, final rules implementing the Nuclear Waste .

Policy Act ordinarily will be required to be forwarded to the Coa. mission fcr its review.

e. It is essential that the Comission be kept informed of each exercise of the E00's rulemaking authority. Accordingly, the office responsible for preparing a rulemaking package for the ED0's signature must include the note to be inserted in the Weekly Information Report to the Comission for a proposed rule or the Daily Staff Notes for a final rule. See Section D.3.a. and b. below.
2. Preparation of Rulemaking Paper The staff office responsible for initiating a rule must make an initial determination of whether the rule falls within the scope of the ED0's rulemaking authority (see Section D.I.),
a. If the rule does not fall within the scope of the E00's rulemaking authority, the rule should be prepared for forwarding to the Comission in the norm.il Comission paper format. See Chapter III.
b. If the rule does fall within the scope 9f the ED0's rulemaking authority, the rule should be forwarded by memorandum to the EDO. The memorandum should explain the basis and purpose of the rule. In '
