CLARIFICATION OF AUGUST 14, 1996, CONFIRMATORY ORDER ESTABLISHING INDEPENDENT CORRECTIVE ACTION VERIFICATION PROGRAM - MILLSTONE NUCLEAR POWER STATION, UNITS 1, 2, AND 3
Dear Mr. Carns:
i On August 12, 1996, the U.S. Nuclear Regulatory Commission (NRC) staff met with the staff of Northeast Nuclear Energy Company (NNECO) regarding 1
programmatic weaknesses in design and configuration control at Millstone Nuclear Power Station, Units 1, 2, and 3.
By letter dated August 13, 1996, 4
NNECO submitted its plan and commitments for such an independent review. On August 14, 1996, the NRC issued a confirmatory order establishing the Independent Corrective Action Verification Program (ICAVP) for Millstone Units 1, 2, and 3.
The order confirmed NNECO's plan and commitments regarding the conduct of an ICAVP, contained in the August 13, 1996, letter to the NRC.
As issued, the order states in Section IV, Paragraph 1:
"The ICAVP review shall begin after the Licensee has completed the problem identification phase of the CMP (Configuration Management Plan], including the activities of the QA organization." As indicated in the transcribed meeting on August 12, 1996, between the NRC and NNECO, it was not the intent of the NRC to prevent the initiation of the ICAVP until completion of the entire problem identification phase of the CMP.
Rather, it is the NRC's intent that the ICAVP may begin when the problem identification phase is completed for a sufficient number of systems to permit selection of an initial representative sample, by the NRC, for review by the ICAVP. After NNEC0 has completed the entire problem identification phase of the CMP, the NRC will select an additional system or systems that will be reviewed by the ICAVP. This will provide additional assurance that the problem identification phase of the CMP has been done with / _
the same rigor and depth for all systems within the scope of the CMP. The U
review of a representative sample of systems by the ICAVP will allow both the licensee and the NRC to make judgments on the effectiveness of the licensee's yO/
problem identification process. Therefore,Section IV, Paragraph 1 of the confirmatory order issued on August 14, 1996, is hereby clarified to provide as follows:

The Licensee shall implement an Independent Corrective Action Verification Program (ICAVP) for each Millstone Unit to confirm that the plant's physical and functional characteristics are in conformance with its licensing and design bases.

provided that among these initial systems are systems deemed suitable by the NRC for the inclusion in the ICAVP. After NNEC0 has completed the entire problem identification phase of the CMP, the NRC will select an additional system or systems that will be reviewed by the ICAVP. The ICAVP shall be performed and completed for each Unit, to the satisfaction of the NRC, prior to the Unit's restart.
