Dear Mr. Fiore:
I am responding to your letter of February 19. 1997, which requested that the U.S. Deaartment of Energy (DOE) be assigned cooperating agency status under 10 CFR 3 art 51 for U.S. Nuclear Regulatory Commission-licensed sites that may be considered for transfer of ownership to DOE pursuant to Section 151(b) of the Nuclear Waste Policy Act of 1982, as amended.
In your letter, you identified 13 sites currently included in our Site Decommissioning Management J
Plan that may be candidates for such a transfer.
Consistent with your request and to facilitate any associated environmental l
reviews, cooperating agency status is granted to DOE for these~ sites. At the request of your staff, my staff is currently assembling related information for each of these sites.
You should be aware that environmental impacts statements (EISs) are already under development for several of these sites. A draft EIS has been developed for the Shieldalloy. Cambridge. Ohio, site and we are currently preparing the final EIS. Draft EISs are under develoament for the Babcock and Wilcox (B&W)
Shallow Land Disposal Area (SLDA) and t1e Sequoyah Fuels Corporation (SFC)'
site. We plan to publish the DEIS for the B&W SLDA in June 1997 and the DEIS for SFC in December 1997.
Because of the advanced state of EIS development for, the Shieldalloy and B&W'SLDA sites. DOE's mvolvement as a cooperating agency.for these sites may be limited but we will keep you informed.

We look forward to working with ~your staff to complete the Memorandum of Understanding that will. set forth the 3rocess and requirements for determining whether DOEtwill assume Federal owners 11p and managements of such sites.
