FACILITIES SECURITY CLEARANCE AT NRC-LICENSED FACILITIES PARTICIPATING IN DOE'S PROGRAM FOR TRITIUM PRODUCTION

Dear Mr. Sohinki:

As my January 3, 1997, le.tter to you indicated, the staff has been considering Section 8.3 of the DOE report PNNL-ll419, " Report on the Evaluation of the Tritium Producing Burnable Absorber Rod Lead Test Assembly," submitted by letter dated December 4, 1996. The staff has now completed its review of Section 8.3 with respect to the facilities (security) clearance (FCL), and has i

decided to retain the FCL over the facilities in question.

The staff's decision is based on the NRC's overall responsibility for and the continuing regulatory authority over the facilities in question. We believe that NRC should perform the functions of the Cognizant Security Agency, as j

delineated in the " Memorandum of Understanding Between the Department of Energy and the United States Nuclear Regulatory Commission Under the Provisions of the National Industrial Security Program," dated September 19, 1996, except for the personnel security clearance function.
