Gentlemen:

i In a telephone discussion between Mr. Gray and Mr. Hirsch on September 11, 1985, Mr. Hirsch suggested that in order to facilitate agreement among the

\ parties regarding a stipulation and termination of the pending proceeding, i the Staff propose license conditions for the UCLA research reactor which i

.would prohibit operation ever again and require dismantlement by a date certain. In accord witn this suggestion I have developed the following proposed language for addition to NRC License R-71 for the UCLA reactor, for your censideration. I have also enclosed a copy of License R-71 with this language added and with those sections deleted as recently requested by UCLA. .*

1. The Atenic Energy Com=ission ("the Coc=ission") has found that:

A. The application, as amended, complies with the requirements of the Ato=ic Energy Act of 1954, as amended ("the Act"), and the regulations of the Comission set forth in 10 CFR Chapter I;

B. Ccnstruction of the facility has been completed substantially in

- confor=1ty with Construction Permit No. CPRR-42 and the application, the provisions of the Act, and the rules and regulations of the

. Cc==ission; g C. The f acility will operate in conforiity with the applicatien, the provisions of the Act, and the rules and regulations of the Comission; D. There is reasonable assurance (i) that the activities authorized by this operating license can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the regulations of the Com=ission; E. The applicant is technically and financially qualified to engage in' the activities authorized by this operating license in accordance with the rules and regulations of the Co= mission;

,s F. The applicant is a nonprofit educational institution and will use the facility for the conduct of educational activities. The applicant is therefore exempt from the financial protection require =ent of subsection 170a of the Act; and G. The issuance of this license will not be inimical to the common defense and security or to the health and safety of the public. ,

2. Facility License Ec. R-71, as amended, is hereby'a= ended in 1'ts entirety te read:

A. This license applies to the Argonaut-type nuclear reactor (hareinafter the reactori vhich is owned by the Fegents of the University of California (hereinafter t.he University of California or the licensee) lor.ated on its canous in los Argeles, California, and described in the licensee's apriication dated February 20, 1970, as ar. ended.

c. Sub.iect to the conditions and requiremants incorporated -

herein, the Corrission hereby licenses the University o' Califernia:

(1) Fursuant in Secticn 104c of the Act ar.d 10 CFR Fart 50 "Dorestic Licersine cf Production and Utilization Facilities," to possess but not operate the reactor as a utilization facilty at the designated location in los Angeles,
