SUBJECT:
REVISION OF INSPECTION PROCEDURE 87103. INSPECTION OF INCIDENTS AT NUCLEAR MATERIALS FACILITIES Pursuant to your memorandum of January 17 1997, the Division of Waste Mariage.nent staff has reviewed the Insaection Procedure 87103.
We do not have any recommendations for revision of t1e current Inspection Procedure, and we f nd the scope and content of Appendix B. " Guidance for Inspection of i
Materials Licensees Who Have Filed for Bankruptcy" to be reasonable and appropriate.
However, we believe a caution statement should also be included in the text of the appendix.
The recommended addition is the following sentence from section 3.f. (page 4) of Policy and Guidance Directive PG 8-11.
"NMSS Procedures for Reviewing Declarations of Bankruptcy."
Any steps to secure the site should be taken only after consultation with OGC. to ensure that NRC's rights to compel the debtor to satisfy its public health, safety, and environmental obligations, or to pursue any claim against the assets of the bankruptcy estate would not be unnecessarily prejudiced.
This statement would increase awareness for OGC consultation by the inspectors who may need to secure the site after the licensee has filed for bankruptcy or an involuntary petition has been filed against it.
We propose that this sentence be inserted near the end of the current opening paragraph in Appendix B such as between the next to last sentence and the last sentence of the paragraph.
