SURRY POWER STATION UNITS 1 AND 2 REPLY TO A NOTICE OF VIOLATION NRC INSPECTION REPORT NOS. 50-280/96-10 AND 50-281/96-10 IA 96-071 I nave reviewed your letter dated November 1,1996 and the enclosed Notice of Violation (NOV). I accept full responsibility for my errors in judgment relative to this event and have had taken actions taken against me regarding my employment which ensure that I will not commit similar errors in the future. However, I take exception to the characterization of the violation regarding my actions. As described in the attached reply, I never intended to mislead or to falsify station records during this event. I do not believe that my actions constitute deliberate misconduct because there was no malicious intent in my actions. My errors in judgment arose from a misguided attempt to minimize workers' exposure due to an inappropriate interpretation of the radiation work permit procedure, and a lack of thorough documentation and communication of those actions.

I respectfully request that I be given the opportunity for a pre-decisional enforcement conference to provide my clarifications and insights on my actions and the events of August 17,1996 regarding the containment work on the 1B reactor coolant pump motor. Furthermore, I request that the Notice of Violation and related correspondence be withheld from the Public Document Room pending the outcome of the pre-decisional enforcement conference, as well as my appeal process currently ongoing with Virginia Electric and Power Company.
