RESPONSE TO AUGUST 29, 1996, LETTER

Dear Mr. Pierce:

This letter responds to your August 29, 1996, request for U.S. Nuclear Regulatory Commission to release the South wing of your facility at 540 East 105th Street for unrestricted use, prior to releasing the remainder of the facility. At this time the NRC does have sufficient information to justify releasing the South wing prior to releasing the remainder of the facility.

NRC cannot release any portion of the site without reviewing the Site Characterization Report, the final Remediation Plan, and final survey data, as a minimum.

This information and results from inspections during final site survey will be used to define the scope of NRC's confirmatory survey. NRC received the Site Characterization Report on November 8, 1996, and expects to receive a revised Remediation Plan by the end of November.

It is anticipated that Sevenson will receive approval to begin decontamination of the West wing in December 1996, and that decontamination and final site survey can be completed within two months. NRC can then mobilize ORISE to conduct a confirmatory survey.

Therefore, due to the relatively short period of time between submittal of the revised Remediation Plan and completion of the final survey for the entire facility, we cannot justify the expense of mobilizing ORISE to conduct separate confirmatory surveys of the South and West wings.

NRC will make every effort to minimize disruption to present tenants during the confirmatory survey process.

In order to minimize disruption to your weld shop tenants, NRC will work closely with Sevenson to coordinate the schedules for decontamination, final survey, and confirmatory survey in the weld shop.

Tentatively, NRC plans to conduct its confirmatory survey in the weld shop concurrently with Sevenson's final survey.
