IMPOSITION OF CIVIL PENALTY - $ 2.500 By EN 96-038. dated June 13. 1996, the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $2.500 to The Dial Corporation. This action was based on a f
Severity Level III violation involving loss of control of a gauge containing l-byproduct material.
The licensee responded to the Notice in a letters dated July 16. 1996 and j
requested mitigation of the civil penalty. After careful consideration of the i
licensee's responses, the staff has concluded that the licensee did not provide an adequate basis for reduction of the Severity Level or mitigation of the civil penalty.
I Accordingly, an Order Im)osing Civil Monetary Penalty in the amount of $2.500 i
has been issued today.
