Dear Mr. Repka:
This is in response to your letter dated August 15, 1985 in which you requested, pursuant to the Freedom of Information Act (F0IA), records relating to NRC's policies for waiver of fees under the F0IA.
As you point out in your letter, NRC's criteria for waiver of fees is set forth in 10 CFR 9.14a.
They are no other criteria. As you will note, 69.14a(a)(1) provides that the NRC will waive search fees "when the time for search does not exceed four hours, in the aggregate, for a request or series i
of related requests." Most requests involve less than the four hour threshold, and the NRC has routinely responded to the requests by making the records available in the NRC Public Document Room (PDR).
Copies of all FOIA requests received by the NRC for 1982 to present, and the NRC's responses thereto, except those involving personal privacy matters, are available for inspection and copying in the PDR.
I am enclosing for your information a copy of NRC's report to the Congress on the administration of the F0IA for 1984.
As indicated in item 6 of the report, the NRC charged $885.00 in search fees last year.
