Dear Mr. Nellis:

g This refers to your ir cters dated October 22,1996 and November 11,1996, from United Medical Manufactsg Company notifying our office of your loss of two polonium-210 anti-static air guns. The air guns, NRD, Inc. Model P-2051, Serial Numbers 74718 and 74723 originally contained 10 millicuries of polonium-210 each in March 1996, the air j

guns were discovered missing. Search efforts to recover the missing air guns proved unsuccessful. Your investigation concluded that the device was inadvertently disposed of i

as ordinary waste.

i After reviewing this incident, the NRC has determined that violations rf NRC requirements occurred. These violations are cited in the enclosed Notice of Violatian (Notice). A written response is required.

Although the amount of polonium-210 discarded was small, the violations demonstrate the importance of maintaining adequate control of all radioactive material to ensure that

]

improper handling or disposal does not occur. We caution you that any similar violations in the future may result in additional enforcement action, including the imposition of monetary penalties and/or orders suspending, revoking or modifying your license.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, the enclosure, and your response to this letter will be placed in the NRC Public Document Room (PDR). To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without

- redaction.
