EXTENSION OF TIME FOR REPLY
Dear Mr. Feldman:
According to an agreement between counsel for Thermal Science, Inc., the United States of America, and the U.S. Nuclear Regulatory Commission, I am extending the due date for Thermal Science's Answer and Reply to the Notice of Violation and Proposed Imposition of Civil Penalties, from Thursday, December 5, 1996, to Friday, January 31, 1997.
The agreement between counsel is designed to allow sufficient time for the U.S. District Court for the Eastern District of Missouri to consider two pending moticns -- a Motion for Judicial Stay and a Motion for Preliminary Injunction, in the case of Thermal Science. Inc. v. U 5. Nuclear Reaulatory Commission, Case No. 96-4:96CV02282-CAS.
This extension is premised and conditioned on the Court granting a Joint i
Motion, to be filed in this case, which provides that: (1) the Nuclear Regulatory Commission may respond to the plaintiff's two motions on or before December 24, 1996, and that filing will be accomplished by placing it in the U.S. Mail and transmitting a copy of the Response to Thermal Science by i
facsimilie; (2) Thermal Science, Inc., will file any reply by January 10, 1997, with the same definition of filing to apply; and (3) both pleadings may exceed the 15-page limit provided by Local Rules.
If, in ruling on the pending motions, the Court issues a decision which has the practical effect of requiring Thermal Science to file its Answer and Reply, and that decision is issued on or after January 21, 1997, I will again extend the due date to ensure that Thermal Science has fourteen (14) days in which to file its Answer and Reply.
