Dear Mr. Andrews:

The NRC assumed licensing responsibility for exports of nuclear-grade graphite from the Commerce Department as a result of the passage of the Nuclear Non-Proliferation Act of 1978 (NNpA). NRC's export licensing authority encompasses all nuclear-grade graphite, including graphite products, which meets the following specifications: "Graohite with a boron equivalent content of less than 5 parts per million and density greater than 1.5 grams per cubic centimeter." This transfer was coordinated with Comerce and the old CL entry for nuclear grade graphite was deleted.

Recently, it has come to our attention that it may also be appropriate for Commerce to publish a conforming change to the CL entry for " artificial graphite" (CL1673A), to eliminate any overlap with NRC's graphite controls. We would be pleased to work with you and the other interested agencies to implement the above changes in an expeditious fashion.
