SUBJECT: NRC INSPECTION REPORT N0. 150-00009/96-07 and 150-00009/96-08
Dear Mr. Henderson:
This refers to the inspection conducted on August 6-7, 1996, at your Fort
Walton Beach and Pensacola, Florida facilities. The purpose of the inspection
was to follow up on your use of byproduct material without an NRC license at .
Eglin Air Force Base, Hurlburt Field and Pensacola Naval Air Station, Florida. I
At the conclusion of the onsite inspection, the findings were discussed with !
you.
Areas examined during the inspection are identified in the report. Within
these areas, the inspection consisted of selective examinations of procedures )
and representative records and interviews with personnel.
!
Based on the results of this inspection, one apparent violation was identified
and is being considered for enforcement action in accordance with the " General
Statement of Policy and Procedures for NRC Enforcement Actions" (Enforcement !
Policy),NUREG-1600. The apparent violation is of concern because the failure !
to file for reciprocity prior to engaging in activities conducted in areas of
exclusive Federal jurisdiction denies the NRC the opportunity to inspect and ,
ensure that-the public health and safety is protected. Accordingly, no Notice l
of Violation is presently being issued for this finding. In addition, please
be advised that the number and characterization of the apparent violation
described in the enclosed inspection report may change as a result of further
NRC review.

You will be advised by separate correspondence of the results of our
deliberations on this matter. No response regarding the apparent violatic, is
required at this time.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of
this letter, its enclosure, and any reply will be placed in the NRC Public
Document Room.
