SUBJECT:
REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE RIVER BEND STATION, UNIT 1 (TAC NO. M96509)
Dear Mr. McGaha:
l l
By Entergy Operations, Inc. (E01), application dated August 29, 1996, and General Electric Company (GE) affidavit dated July 11, 1996, executed by Michael A. Smith, E01 submitted "T-Factor Setdown Elimination Analysis For River Bend Station" and requested that it be withheld from public disclosure j
pursuant to 10 CFR 2.790.
GE stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
"Some examples of categories of information which fit into the definition of proprietary information are:
Information that discloses a process, method, or apparatus, a.
including supporting data and analyses, where prevention of its use by General Electric's competitors without license from General Electric constitutes a competitive economic advantage over other companies, b.
Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product;"
In addition:
"The information identified in paragraph (2), above, is classified as proprietary because it contains detailed results of analytical models, methods and processes, including computer codes, which GE has developed, obtained NRC approval of, and applied to perform evaluations of instrument setpoints for BWR's.
The development and approval of the BWR setpoint methodology was achieved at a significant cost, on the order of a million dollars, to GE.

l We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have l
determined that the submitted information sought to be withheld contains proprietary commercial information.
l Therefore, the applicable portions of the document marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
