ORDER On the unopposed motion of the State of New York, and for good cause shown, the time for the filing of the State's brief in support of its appeal from the Licensing Board's 1
April 17, 1985 partial initial decision is extended to September 30, 1985.2 LBP-85-12, 21 NRC 644.
We are told by the State that the NRC staff's consent was conditioned upon its being provided with an " equivalent" extension of the time for the filing of its responsive brief.
In our August 20, 1985 order granting Suffolk County's motion for an extension identical to that now sought by the State, we expressed the view that such a condition is plainly inappropriate.
We note anew that, upon the filing of the State and County briefs, the staff will have ample opportunity to request an extension of its briefing time if justification exists for such relief.
