Dear Ms. Bell:
This is a partial response to your letter dated June 17, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA) copies of five categories of documents regarding pollution control bonds for plants.
The documents listed on the enclosed Appendix A are responsive to your request and are being placed in the NRC Public Document Room (PDR),1717 H Street, NW, Washington, DC 20555. You may obtain access to these records by presenting a copy of this letter to the PDR staff or by requesting folder F01A-85-426 under your name.
The two-page do:ument listed on Appendix B is being withheld in its entirety from public disclosure pursuant to Exemption (5). This document constitutes a predecisional intragency note, the release of which could interfere in the future with the candid expression of opinions by the staff. Therefore, the document is exempt from mandatory disclosure pursuant to Exemption (5) of the FOIA (5 U.S.C. 552(b)(5)), and 10 CFR 9.5(a)(5) of the Comission's regula-tions. Release of the document would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. The document does not contain any reasonably segregable factual portions.
Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. Guy H. Cunningham, Executive Legal Director.
This denial may be appealed to the Comission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Comission, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an
