Dear Ms. Bell:

This is in further response to your letter dated June 1, 1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), two categories of documents relating to operation of the Grand Gulf nuclear power reactor and the Transamerica Delaval, Inc., diesel generators in use at the Grand Gulf nuclear power plant.

The records listed on the enclosed Appendix D are responsive to your request.

These records, with the exception of number seven, are being withheld in their entirety. Document one consists of the staff's draft answers to questions on the license application for Grand Gulf. These answers contain opinions, views, coments, and recommendations with regard to this application. A copy of the record containing the staff's final answers to these questions has previously been placed in the NRC's Public Document Room. You may inspect this document l

by referencing the accession number listed at number seven of Appendix D.

The I

remaining records listed on the appendix contain predecisional information relating to a sensitive issue on which the staff has y9t w make a final decision. Also, this issue could eventually result in an enforcement action.

Release of these records would tend to inhibit the open and frank exchange of ideas and other information essential to the deliberative process. The records, therefore, are exempt from mandatory disclosure pursuant to Exemption (5) of the FOIA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Pursuant to 10 CFR 9.9 and 9.15 of the Consnission's regulations, it has been determined that the information withheld is exempt from production or dis-closure, and that its production or disclosure is contrary to the public interest. The person responsible for the denial of document one is Mr. Carlton Kammerer, Director, Office of Congressional Affairs. The persons responsible for the denial of documents two through six on Appendix D are the j

undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

The denials by Mr. Denton and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S.

Nuclear Pegulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denial by Mr. Kammerer may be appealed within 30 days to the Secretary of the Commission and should be addressed to the Secretary of the Connission.

This completes NRC's action on your request.
