Dear Mr. Thorne:
This refers to your letter of July 15 concerning the following requests for the transfer of U.S.-origin technology to the People's Republic of China:
o Bechtel Power Corporation, to provide engineering, procurement, )
construction, quality assurance / quality control, and project management services for the Guangdong nuclear power plant project, o Conax Buffalo Corporation, to provide containment penetration technology to designers of Chinese nuclear power plants, and o Westinghouse Electric Corporation, to provide instrumentation for the Qinchan(728)nuclearpowerplantproject. I 1
The NRC staff has reviewed these requests and notes that current Executive Branch policy with respect to nuclear exports such as these to the PRC has not been established as yet. Accordingly, we are deferring action on these requests, as well as on the requests forwarded previously for review, until such times as the necessary policy decisions have been made. In this regard, !
we are particularly interested in the possible effect of the recent action on the proposed U.S./PRC Agreement with respect to the Executive Branch's position on all of the pending PRC Part 810 cases, i
