EVALUATION OF ANL PROPOSALS (A 2156 and A 2157)

The enclosed proposals were received recently from Argonne National Laboratory.

The proposal for FIN A 2157 is in response to the NMSS request of July 19, 1979.

Please review the proposals for acceptability.

It is acted that the FY80 funding requirements in the proposals are not presently covered, according to the latest MMSS FY80 Financial Plan.

Specifically, there are no funds budgeted for FIN A 2156 and only $50K budgeted for FIN A 2157, as opposed the ANL proposed amounts of $60K and $80K 'respectively.

Please address this apparent shortfall as well as any changes required to the current statements of work and/or proposals for these-FINS.

Please advise Program Support (Don Loosley) of your evaluation by return memo by October 5,1979.

1.0 Background

Evaluation of probable or potential environmental impacts is an integral part of the licensing pmcess for uranium fuel cycle facilities.

In accordance with Nuclear Regulatory Comission (NRC) regulations, environ-mental appraisals or environmental impact statements (EIS) are require'd to support licensing decisions on new license applications, license renewals, proposed major nodifications of facilities, and, in some cases, decomissioning plans for uranium recovery operations, fuel processing i

and fabrication faciTities, and for related types of activities. The

NRC's Office of Nuclear Material Safety and Safeguards (NMSS) requires j

technical assistance in conducting its environmental evaluations of j

applicant proposals and in the preparation of the associated envi.ron-mental appraisal reports and environnental impact statements (draft andL final statements).

Argonne National Laboratory (ANL) has provided such assistance in FY79 under NMSS Project A2010-9 and in FY80 and FY81 j

FIN A2157.

This project is a continuation of that effort.

  • i 2.0 Work Recuired The perforuiing organization shall furnish the necessary qualified personnel, facilities, materials and services to conplete the final environmental statement for the Kerr-McGee West Chicago task initiated in FY78 under FIN No. A2010.

This will include the msolution of comnents received on the draft envimnmental statement. The target task completion date will be durino the 4th Quarter of FY82.

3.0 Reporting Recuirements 3.1 Monthly Letter-Status Report Each nonth, the perfonning organization shall submit six (5)[ copies...-

of a brief letter report which sumarizes:

(1) the work performed during the previous month; (2)(personnel time expenditures during the pre month; and (3) costs:

a) during the previous month, (b) cumulative to date (fiscal year and total), and (c) projection by month to completion of i

the work effort covend by this statement of work. The f'rst nonthly report shall provide the initial projection and subsequent reports shall i

either indicate revised projections or indicate "no change in the cost proj ection." The report shall be due by the 15th of each nonth with distribution as follows:

, 3.2 Preliminary Draft Environmental Impact Statement (EIS), Draf t EIS and Final EIS A revised preliminary draft of the EIS will be completed and submitted in the second quarter of FY82.

Following review by NMSS staff, the draft EIS (DEIS) will be issued by the end of the second quarter of FY82.

The printed final environmental statement, consisting of the revised EIS, the comments on the DEIS from other Federal / State agencies and the private sector, and appropriate responses to these connents will be released within the fourth quarter of FY82.

The following number of copies of the required reports shall be furnishe'd by the performing organization:

Preliminary Draft EIS - 5 copies Draft EIS - 50 copies Final EIS - 50 copies 4.0 Meetinos and Travel The performing organization shall meet approximately four times with the NMSS PM to discuss the results of the work. Those meetings shall be of one day's duration and shall be held at the NRC offices in Silver Spring, Maryland.

5.0 NRC Furnished Material There will be no NRC furnished material.

6.0 Period of Performance Performance under this work order shall commence on October 15, 1981, and shall continue through October 15, 1982.

7.0 Technical Direction Mr. W. A. Nixon (FTS 427-4510) is designated as the NMSS Project Manager (PM) for the purpose of assuring that the services required under this 50W are delivered in accordance herewith.

All technical instructions to the DOE performing organization shall be issued through the NMSS PM.

As used herein, technical instructions are instructions to the Contractor which provide details, suggest possible lines of inquiry, or l

Technical instructions shall not constitute new assignments of work or changes of l

such a nature as to justify an adjustment in cost of period of performance.

Direction for changes in cost or period of performance will be provided..

by the DOE Operations Office after receipt of an appropriate NRC Form 173 1

from the Director of the Office of Nuclear Material Safety and Safeguards (NMSS).

If the DOE performing organization receives guidance from the NMSS PM which is believed to be invalid under the criteria cited above, the performing organization shall immediately notify the NMSS PM.

If the NMSS PM and the performing organization are not able to resolve the question within five days, the perfoi...ing organization shall notify the DOE Operations Office.

8.0 Discosal of Procerty Upon completion of a. program or termination of a project, a reconciled report will be developed jointly by DOE an'd NRC to record available equipment and related material purchased with NRC funds.

This report should be developed as soon as possible af ter program completion'or termination decision has been made, but not later than sixty (50) days after work termination date. The report 'should be submitted to the Property and Supply Branch, NRC.

In accordance with Nuclear Regulatory Comission (NRC) mgulations, environ-mental appraisals or environmental impact statements (EIS) are required to support licensing decisions on new license applications, license renewals, proposed major modifications of facilities, and, in some cases, decomissioning plans for uranium recovery operations, fuel processing and fabrication facilities, and for related types of activities. The NRC's Office of Nuclear Material Safety and Safeguards (NMSS) requires 4

technical assistance in conducting its envirtnmental evaluations of applicant proposals and in the preparation of the associated environ-mental appraisal mports and environmental impact statements (draft and final statements). Argonne National Laboratory (ANL) has provided such assistance in FY79 under NMSS Project A2010-9 and in FY80 under FIN A2157-0. This project is a continuation of that effort.

2.0 Work Required i

The perfoming organization shall furnish the necessary qualified personnel, facilities, materiats and services to complete the final environmental statement for the Kerr-McGee West Chicago task initiated in FY78 under FIN No. A2010. This will include the resolution of comments mceived on the draft environmental statement.

The target task completion date will be during the 4th Quarter of FY81.

-2 3.2 Preliminary Draft Environmental ' Impact Statement (EIS) And Draft EIS The performing organization shall submit a pmliminary draft EIS (5 copies) to the NMSS Project Manager concerning the site by January 1,1981. The fomat of the report will follow the outline submitted to NRC by ANL in a letter dated August 13, 1980.

The NMSS Project Manager shall provide written coments to the perfoming organization by February 1,1981.

The performing organiza-tion shall include these coments in the draft EIS which shall be provided to the NMSS Project Manager (50 copies) by March 1,1981.

The project schedule after March 1,1981 cannot yet be determined because of the unknown length of the public coment period and other variables. However, this S0W shall be amended by issuance of an NRC Form 173 before October 31, 1981 to define the mmainder of the project schedule. When the schedule is redefined the NMSS PM will furnish coments on the draft EIS to the perfoming organization. Based on these coments, the perfoming organization shall revise the draft and submit the final CIS fifty (50) copies to the NMSS PM and one (1) to the Office of the Director, NMSS (Program Support) not later than one month after coment on the draft EIS have been received (See Paragraph 12 of the Tems and Conditions Standard Order for DOE Work).

4.0 Meetings and Travel -

The perfoming organization shall meet approximately four times with the NMSS PM to discuss the results of the work. Those meetings shall be of one day's duration and shall be held at the NRC offices in Silver Spring, Maryland.

1.0 Backgr;und I

Evaluation of probable or potential environmental impacts -is an integral part of the licensing process for uranium fuel cycle facilities.

In accordance with Nuclear Regulatory Comission (NRC) regulations, environ-mental appraisals or environmental impact statements (EIS) are required to support licensing decisions on new license applications, license renewals, i

proposed major modifications of facilities, and, in some cases, decomis-sioning plans for uranium recovery operations, fuel processing and fabrication facilities, and for related types of activities. The NRC's Office of Nuclear Material Safety and Safeguards (NMSS) requires technical i

assistance in conducting its environmental evaluations of applicant proposals e

and in the preparation of the associated environrantal appraisal reports and environmental igact statements (draft and final statements). Argonne National Laboratory (ANL) has provided such assistance in FY79 under NMSS j

Project A2010-9. This project (A2157-0) is related to that effort.

j 2.0 Work Required The performing organization shall furnish the necessary qualified personnel, j

facilities,-materials and services to complete the final environmental state-1 ment for the Kerr-McGee West Chicago task initiated in FY78 under FIN No.

A2010. This will include the, preparation of a revised draft environmental

]

impact statement reflecting the. latest available information on decomissioning

-l and stabilization alternatives, the. resolution of coments received on the 4

j draft report and preparation of a final environmental impact statement. The I

target task completion date will be durina the 4th Quarter of FY 80.

l 3.0 Reporting Requirements l

3.1 Monthly Letter Status Report Each month, the performing organization shall submit eleven (11) copies of a brief letter report which sumarizes:

(1) the work performed during the i

previous month; (2) personnel time expenditures during the previous month; i

, 3.1 Monthly Letter Status Report (Continued) and (3) costs:

(a) during the previous month, (b) cumulative to date (fiscal year and total), and (c) projection by month to completion of the work effort rovered by this statement of work.

The first monthly report shall provide the initial projection and subsequent reports shall either indicate revised projections or indicate "no change in the cost projection." The report shall be due by the 15th of each month with distribution as follows:

NMSS,10 copies Office of the Director, NMSS (Program Support),1 copy 3.2 Interim and Final Technical Report A draft interim report (15 copies) shall be submitted concerning the site within 90 days of completion of the site survey. This draft report shall be sent to the NMSS Project Manager (PM).

The detailed format of this report will be agreed upon after the survey because the report will relate on an "ad hoc" basis to the West Chicago site; how-ever, generally the report shall include:

(1) abstract, (2) intro-duction, (3) survey methods; (4) guidelines used to evaluate results, r

-(5) survey results, and (6) references.

The HMSS PM will furnish coments on the draft report to the performing organization within two weeks after receipt of the draft.

Based upon those coments, the performing orga7iTzation shall revise the draft and submit the final report in fifteen (15) copies to the NMSS PM and one (1) to the Office of the Director, NMSS (Program Support) not later than one month after coments on the draft report have been received.

(See Paragraph 12 of Terms and Conditions Standard Order for 00E Work.)

4.0 Meetings and Travel The performing organization shall meet approximately four times with the NMSS PM to discuss the results of the work. These meetings shall be of one day's duration and shall be held at the NRC offices in Silver Spring, Maryland.

5.0 NRC Furnished Material There will be no NRC furnished material.

6.0 Period of Performance Performance under this work order shall comence on October 1,1979, and shall continue through Septenber 30, 1980.

7.0 Technical Direction l

Mr. W. A. Nixon.(FTS 427 4510)is designated as the NMSS Project Manager (PM) for the purpose of assuring that the services required under this S0W are delivered in accordance herewith.

All technical instructions to the DOE performing organization shall be issued through the NMSS PM. As used herein, technical instructions are instructions to the Contractor which provide details, suggest possible lines of inquiry, or otherwise complete the general scope of work set forth herein. Technical instructions shall not constitute new assignments of work or changes of such a nature as to justify an adjustment in cost of period of performance.

Direction for changes in cost or period of performance will be provided by the DOE Operations Office after receipt of an appropriate NRC Form 173 from the Director of the Office of Nuclear Material Safety and Safeguards (NMSS).

If the DOE performing organization receives guidance from the NMSS PM which is believed to be invalid under the criteria cited above, the performing organization shall imediately notify the NMSS PM.

If the NMSS PM and the performing organiztion are not able to resolve the question within five days, the performing organization shall notify the DOE Operations Office.

8.0 Disposal of Property Upon completion of a program or termination of a project, a reconciled report will be developed jointly by DOE and NRC to record available

equipment and related material purchased with NRC funds. This report should be developed as soon as possible after program completion or termination decision has been made, but not later than sixty (60) days after work termination date. The report should be submitted to the Property and Supply Branch, NRC.

. Kerr-McGee (A2157) - J. L. Saguinsin, Project Leader The revised EIS outline was sent to the NRC EPM (W. A. Nixon) in the middle of the month. Two new alternatives were included: Alternative III - Off-Site Disposal at Currently Unlicensed Storage Sites Within the State Identified by Kerr-McGee, and Alternative IV - Interim (Short-Term)

Decomissioning Alternative.

Work on the EIS has resumed, focusing on the above alternatives. Our goal is to submit a preliminary draft EIS to NRC by November 30 of this year.

These meetings were held in Cheyenne, Wyoming and Denver, Colorado on April 30 and May 1, and were for the most part related to consnents on the Split Rock FES.

. Kerr-McGee (A2157) - J. L. Saguinsin, Project Leader Work on the sampling of Thoron (Radon-220) and Radon (Radon-222) in the West Chicago area is proceeding as scheduled. Also, we are finalizing the portion of the EIS pertaining to on-site stabilization or burial of waste.

Our evaluation will then subsequently focus on the alternative of off-site disposal based on specific site (s) indicated by Kerr-McGee.

Title:

Environmental Impact Statement on the Decommissioning of the Kerr-McGee West Chicago Facility 1.

Objective of Proposed Work:

The objective is to prepare an environmental impact statement (EIS) for the decomissioning of the West Chicago facility and to undertake site surveys and field measurements necessary for an adequate characterization of the burial site environment.

Similar characterizations will be made for disposal sites identified as likely candidate alternate sites by Kerr-McGee and by us in consultation with the NRC environmental project manager.

The completed EIS will serve as a basis for the NRC action on the application by Kerr-McGee for the ultimate disposition of its West Chicago facility.

The EIS will contain a characterization of existing conditions at the site, including the potential for migration of radionuclides.

A number of decom-missioning alternatives will be evaluated, including:

1) permanent onsite disposal or burial of thorium and rare earth residuals under one or more engineered configurations; 2) onsite storage for an indeterminate period of time with later consideration of disposal; and 3) packaging and shipment of residuals to other possible candidate burial sites, including those within and beyond the State of Illinois.

Sumary of Prior Efforts:

ANL completed work on the assessme.nt of pemanent onsite disposal of wastes and site decomissioning. Sites identified by Kerr-McGee as the most promising alternative burial sites within Illinois were also evaluated. These included abandoned surface coal mines, limestone quarries and clay / shale quarries. A preliminary draft EIS was submitted to NRC in May,1981.

Radon and thoron measurements were also conducted in the West Chicago area to establish useful baseline information for background levels of these two gaseous emanations.

Work to be Ferfomed and Expected Results:

The remaining work on the EIS will be concluded, with emphasis placed on the assessment of the alternative involving onsite storage of wastes for an in-determinate period of time with later consideration for disposal. A revised preliminary draft of the EIS will then be completed and submitted in the second quarter of FY82.

F'ollowing review by NMSS staff, the draft EIS (DEIS) will be issued by the end of the second quarter of FY82.

The printed final environmental statement, consisting of the revised EIS, the coments on the DEIS from other federal / state agencies and the private sector, and appropriate responses to these coments will be released within the fourth quarter of FY82.

Accomplishments for NMSS in FY 1980 ANL essentially completed the_gortion of the draft EIS pertaining to onsite burial of wastes and site decommissioning.

area for NRC, Office of Inspection and Enforcement, Region III.

The results were published as NUREG/CR-0413.
