INTERIM CRITERIA FOR USE IN MAKING DECISIONS UNDER 10 CFR 76.45(b)
My staff has reconsidered the interim criteria to be used in reviewing applications for amendments to USEC's certificates, in order to make the determinations required in 10 CFR 70.45(b) with respect to whether activities proposed in USEC's applications for solendment of the certificate are significant, we will use the criteria presented below on an interim basis until such time as more permanent guidance is established.
Proposed activities shall be determined to be not significant if all the following conditions' are met:
- 1. There is no change in the types or significant increase in the amounts of any effluents that may be released offsite.
II. There is no significant increase in individual or cumulative occupational radiation exposure.
Ill. There is no significant construction impact.
IV. There is no significant increase in the potential for, or radiological or chemical consequences from, previously analyzed accidents.
V. The proposed changes do not result in the possibility of a new or different kind of accident.
VI. There is no significant reduction in any margin of safety.
Vll. The proposed changes will not result in an overall decrease in the effectiveness of the plant's safety, safeguards or security programs.
Any proposed activities not meeting all of the above criteria shall be deemed to be significant pursuant to 10 CFR 76.45(b).
