l CHAIRMAN JACKSON'S COMMENTS ON SECY-96-252-I approve the staff's recommendations in SECY-96-252. This approval also includes extending-the license term from 5-years to 10-years for licenses to manufacture and/or transfer byproduct

material, issued pursuant to 10 CFR Part 32.

! While SECY-96-252 makes a strong argument for license term extension, the staff should identify high priorities in the materials program where the resources saved by license term 4

extension can be reprogrammed more effectively to promote the Nuclear Regulatory Commission's mission.

I I also approve the staff's option to issue licenses for terms shorter than 10-years on a case-specific basis and for situations where the industry or NRC has not had extensive experience in i

using or regulating the proposed use of the material. This is an j- excellent opportunity to make the NRC's regulatory program more performance-based, and the staff should invoke this option whenever appropriate. The staff should consider whether guidance to licensing staff on this issue is sufficient, and report back to the Commission. If the staff determines that further guidance or procedures are needed regarding case-specific issuance of short license terms to materials licensees, then the staff should develop such guidance or procedures.
