Enclosed for the information of the Subcommittee is a copy of a revision to i the NRC's General Statement of Policy and Procedure for Enforcement Actions ,

(Enforcement Policy). This document will be published in the Federal I Reaister.

The revision is being made to address issues associated with open l predecisional enforcement conferences and staff consultation with the l Commission. The revision provides that most predecisional enforcement l conferences will be open to public observation. It also simplifies the situations in which the Commission must be consulted prior to the staff taking

enforcement action. In addition, further guidance is provided concerning consideration of risk in developing sanctions and the circumstances in which a ,

j ,, licensee identified violation will be treated as a non-cited violation.

We have determined that this policy revision is not a " major rule" as defined in 5 U.S.C. 804(2). We have confirmed this determination with the Office of Management and Budget.

'This policy revision will become effective when published in the Federal Reaister.
