.O APPENDIX A NOTICE OF VIOLATION American Hoechst Corporation Docket No. 99990001 Delaware City, Delaware License No. General License As a result of the inspection conducted on August 29, 1985, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the followir.g violations were identified:
10 CFR 31.5(c)(2) requires that each device possessed pursuant to 10 CFR 31.5(a) be tested for the proper operation of the on-off mechanism and indi-cator, if any, at no longer than six-month intervals.
10 CFR 31.5(c)(3) re-quires that test required by 10 CFR 31.2(c)(2) and other testing, installation, servicing, and removal from installation involving the radioactive materials, its shielding or containment are performed by a person holding a specific license pursuant to Parts 30 and 32 of 10 CFR or from an Agreement State to perform such activities.
Contrary to the above, as of August 29, 1985, a gauge containing 1.2 curies of Krypton-85 had not had the on-off mechanism and indicator tested for proper operation since October 1984.
This is a Severity Level IV (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, American Hoechst Corporation is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; cnd (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
