Descriphon of Changes Incorporated by Modification No. 98 to NRC-02-93-005 Page 2 The purpose of this modification is to show the B&R numbers for the transfer of funds from Job Code B6666 to Job Code 01035,ccomplished in Modification No. 97, to revise Section H.16.3 of the contr

.t. and to add new Project Officers to the Hanford Tank Waste System project.

Accordingly, the following changes are made:

Revise Block 12 of SF30 on Modification No. 97 to show that the cited funds are being transferred from RES B&R No. 56015252005 into NMSS B&R 1

No. 55015251005.

Revise the second paragraph of section H.16.3 of the contract to delete the first part of the first sentence since procedures have been approved.

See attached change page 46.

Revise Section G.3.1.C to add new Project Officers as shown on the attached page 26.

All other terms and conditions of this contract, including the ceiling amount for the first renewal period of $89.898.141.00, remain the same.

- H.16.3 Limitation of Contractina The contractor agrees that due to the Center's special relationship with the NRC. the contractor will not accept any commercial contract for work at the Center, nor will the contractor contract with any other governmental agency for work at the Center without the prior written approval of the Contracting Officer.

1 The contractor is permitted to utilize Center staff when such staff are not being fully utilized by NRC's waste management program and no conflict or potential conflict of interest exists. Any such use of 4

personnel for more than 30 days within a six-month period will require the prior written approval of the Contracting Officer.

H.17 Maintenance of the Center The contractor shall maintain the CNWRA which includes as a minimum:

Business Entity The CNWRA shall remain as an autonomous entity that meets the FFRDC i

requirements of 0FPP Policy Letter 84-1, Attachment 3. and Part 35 of the Federal Acquisition Regulations.

The Center shall be operated as a not-for-profit organization free of control by any organization whose affiliations could give rise l

to a conflict of interest.

Organizing and Staffing i

The Center shall be organized and staffed to effectively and efficiently perform the mission stated in the Center Charter (Attachment 2).

C.

Planning and Coordinating The contractor shall plan all activities necessary to effectively perform the mission of the Center and annual NRC review and approval of the Center program of work and operations. Such planning and coordination shall cover projection of resources required to execute Center Operations (technical and managerial) each year for the succeeding five fiscal years.

H.18 Reauirements for Use of Microcomouters by NRC Contractors The contractor shall use only microcomputers and software approved for use by NRC staff and those in the then currently approved CNWRA Report on ADP Requirements.

Any exceptions to this requirement shall be justified by the contractor and approved by the NRC Contracting Officer.

The CNWRA shall submit any questions regarding the microcomputers and microcomputer software currently supported by the NRC to the NRC Contracting Officer.
