SUBJECT:
RECIPROCITY RECOGNITION FOR CALENDAR YEAR 1997 Gentlemen:
The NRC has a method available under which an Agreement State Licensee may gain recognition to work in areas of NRC jurisdiction, including areas of exclusive federal jurisdiction within an Agreement State as well as all areas within non-Agreement States, Puerto Rico, Guam and American Samoa. Regulations at 10 CFR 150.20 (enclosed) state, in part, that an NRC general license will be granted if an Agreement State licensee complies, and is authorized to perform licensed activities at temporary job sites within the Agreement State which issues the license. The license must be current at the time licensed activities are performed. If a license has an expiration date within 1997, prior to performing licensed activities after the expiration date, the licensee must provide NRC with an extension letter or a renewed license.
Work may be performed on any 180 days in calendar year 1997. Work on the same day at multiple locations 4 hall be counted as one work day. Please list on the initial Report of Proposed Activities in Non-Agreement States (NRC Form 241) the client names, locations and tentative dates of work for all of 1997. Material in storage within NRC jurisdiction areas on any day counts a day towards the 180 days allowed. Violations of the reciprocity provisions of 10 CFR Part 150 may result in NRC taking escalated enforcement action. A copy of NUREG 1600 " General Statement of Policy and Procedures for NRC Enforcement Actions" will be provided with an acknowledgement letter.
The regulation requires notification at least 3 days in advance of work. Facsimile reporting will be preferred, but should be made 3 days in advance of work. We have enclosed a fax form which may be used. This office will process the NRC Form 241 for all Agreement State licensees in Region 11. The submittal should include 4 copies of the NRC Form 241,4 copies i
of the Agreement State License, and the initial registration fee of $1100. Revision fees are
$200, and consist of additional work sites and additional clients. Clarifications are not charged a fee, and consist of changes to work dates (addition or deletion), cancellations of work sites and clients. NRC fees are subject to change as part of the budget process. We have enclosed a copy of the pertinent page. Reciprocity licensees will be notified of any such changes. Certain education entities are exempt from NRC fees. We shall notify you should you be one of these. Work off-shore does not have the 180 days in a calendar year restriction.

Prior to working in areas of exclusive federal jurisdiction in Agreement States (such as some portions of federal facilities) the licensee is requested to contact the facility and request a determination of jurisdiction, since the facility best should know its status. We have enclosed a procedure which you may use.
NRC regulations may differ from Agreement State regulations, and will be in effect whenever work is performed in NRC jurisdiction areas. We shall provide you with copies of the pertinent regulations. It is an Agreement State licensee's responsibility to become familiar with the regulations which pertain to their activity.
