Dear Mr. Stolz:

On June 26, 1984, 10 CFR 50.62, Requirements for Reduction of Risk from Anticipated Transients Without Scram (ATWS) Events for Light-Water-Cooled Nuclear Power Plants was issued. This rule required by 180 days after issuance of the quality assurance guidance for non-safety related components each licensee shall submit a proposed schedule for meeting the requirements of paragraphs (c)(1) through (c)(5) of the rule. The schedule specified by the rule calls for final implementation no later than the second refueling outage after July 26, 1984.

Toledo Edison (TED), as a member of the Babcock and Wilcox Owners Group (BWOG) has participated in the formulation of generic design requirements to satisfy the intent of the rule.

In a letter (Document ICAN098508) from Mr. J. Ted Enos, Chairman of the BWOG ATWS Committee, to Mr. Hugh Thompson dated September, 1985, the BWOG submitted the generic B&W design requirements of this modification. The lettei requested NRC concurrence of the generic design requirements by December 31, 1985.

TED is proceeding with design work consistent with the BWOG generic design requirements. TED will implement its design by the end of the Davis-Besse Unit No. 1 fifth refueling outage provided NRC concurrence of the BWOG design requirements is received by December 31, 1985.

If concurrence is not received by this date, final TED design work will be delayed and implementation of the design will be postponed to a subsequent refueling outage.
