SAFETY EVALVATION BY THE OFFICE OF NUCLEAR REACTOR REGVLATION PitATED TO AMENDMENT NO.132 IQ_ FACILITY OPERATING LICENSE NO. NPF-49 NORTHEAST NUCLEAR ENERGY COMPANY. ET AL.
MILLSTONE NUCLEAR POWER STATION. UNIT NO. 3 DOCKET NO. 50-423
1.0 INTRODUCTION
By letter dated September 12, 1995, Northeast Nuclear Energy Company, et al.
(NNECO) requested approval to amend Technical Specification 6.3.1 for the Millstone Nuclear Power Station, Unit No. 3.
The proposed change would no longer require the Operations Manager to hold a Senior Reactor Operator (SR0) license if the Assistant Operations Manager holds an SR0 license.
The changes proposed in this amendment would also delete a related footnote that previously granted a one-time 3-year variance to the qualification requirements for the Operations Manager and permission for the Assistant Operations Manager to hold a license instead of the Operations Manager.
2.0 EVALUATION Title 10 of the Code of federal Regulatfons (10 CFR) Section 50.54(1) requires the licensee to " designate individuals to be responsible for directing the licensed activities of licensed operators. These individuals shall be licensed as senior operators...." NNECO is committed to ANSI N18.1-1971, which requires the Operations Manager to hold an SR0 license for the specific unit at the time of appointment to the active position.
In its submittal of September 12, 1995, NNEC0 maintains that an individual who holds or has held an SR0 license at a pressurized water reactor (PWR) has sufficient and relevant operational experience and knowledge to fill the position of Operations Manager at another PWR. This statement is supported by subsequent ANSI /ANS standards that allow individuals who hold or have held an SR0 license to be appointed to the position of Operations Manager.
The NRC staff also endorsed this position in a safety evaluation dated July 21, 1994, of a similar technical specification change for Millstone Unit 2.
In its submittal dated September 12, 1995, NNEC0 requested a change in Section 6.3.1 of the Technical Specifications that would permit an individual who does not have a current SR0 license to hold the Operations Manager position at Millstone Unit 3.

Millstone Unit 3 SR0 license or have held an SR0 license at a PWR. To meet j
the requirements of 10 CFR 50.54(1), the licensee further stated that if the Operations Manager does not hold an SR0 license for Millstone Unit 3 then the Assistant Operations Manager will hold a license and will also meet the qualification requirements of Section 4.3.8, " Operations" of ANSI /ANS 3.1-j 1987, "American National Standard for Selection, Qualification, and Testing of i
Personnel for Nuclear Power Plants." The staff notes that the on-shift

i in order for the licensee to meet the requirements of 10 CFR 50.54(1).

Additionally, in times of transition, that is, those times when the SR0 i
licensed manager leaves the position, a person with a current SRO must be made I
responsible for the crews in order for the licensee to continue to meet the j
requirements of 10 CFR 50.54(1).
The removal of the related footnote that previously granted an exemption in I
the area of qualification requirements for the Operations Manager is l
appropriate since it is no longer applicable.

The specification that either the Operations Manager or the Assistant Operations Manager hold a Millstone Unit 3 SRO license is consistent with the i
requirements of 10 CFR 50.54(1) and ensures that a licensed off-shift senior operator is directing the licensed activities of the licensed operators provided that the crews report directly to and recei n overall day-to-day i
guidance on plant operations from the individual holding the current Senior l
Reactor Operator license. Requiring an ANSI /ANS-3.1-1987 qualification and licensed Assistant Operations Manager when the Operations Manager does not hold a valid Millstone Unit 3 SR0 license is consistent with the requirements of ANSI N18.1-1971 and ensures there is site-specific detailed relevant j.
technical and systems knowledge in a senior operations management position.

Therefore, the staff concludes that the proposed modification to the Millstone i
Unit 3 Technical Specification 6.3.1 that allows either the Operations Manager i
or the Assistant Operations Manager to hold a valid Millstone Unit 3 SR0 l
license is consistent with and meets the intent of the relevant review criteria. The modification is acceptable provided that the appropriate organizational reporting chain for the crews to the Assistant Operations j
Manager who holds a valid SR0 for Millstone Unit 3 is in place.

3.0 STATE CONSULTATION

official was notified of the proposed issuance of the amendment.
The State official had no comments.
4.0 ENVIRONMENTAL CONSIDERATION

or requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10).
Pursuant to 10 i
CFR 51.22(b) no environmental impact statement or environmental assessment j
need be prepared in connection with the issuance of the amendment.

5.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that:
(1) there is reasonable assurance that the health and safety of the l
public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common j
defense and security or to the health and safety of the public.
