Contract No. NRC-04-95-065, Modification No. 5 Under Task Order No. 2-This confirms verbal authorization provided to you on December 18, 1996, from Deborah Neff, of my staff, to commence work under the subject modification on December 18, 1996, with a temporary ceiling of $20,000.00.
The purpose of this modification is to provide a within scope change to the subject task order which hereby increases the ceiling and obligated amounts by
$75,274.00 from $109.097 to $184,371.00.
Accordingly, the task order is hereby modified as follows:
The contractor shall perform the work described in the attached Statement of Work, and in accordance with the contractor's technical proposals dated October 7, 1996, which is hereby incorporated by reference and made a part of this task order.
The third paragraph of the definitization letter is revised to read as follows:
" Task Order No. 2 shall be in effect from September 25, 1995 through September 24. 1997, at a total estimated cost of $184,371.
The total obligated amount of this task order is $184,371."

MODIFICATION TO TASK 2 TECHNICAL ASSISTANCE FOR RULEMAKINGS AMENDING OF NUCLEAR POWER PLANT DECOMMISSIONING FINANCIAL ASSURANCE REQUIREMENTS BACKGROUND NRC issued Task Order No. 2 in September 1995, requesting ICF to provide technical assistance for two subtasks addressing separate, but related rulemakings. The first subtask related to a cost-requirements rule and the second subtask to an implementation rule. These actions were described in the rulemaking plans contained in SECY-95-223. The task order stated that since the information base for the first rule was further along than for the second, the schedule for the first was much shorter. The NRC estimated the original level of effort (L0E) for both sub-tasks combined to be 1,200 staff hours.
ICF's proposal for the task were based en the NRC estimated LOE, A few months after the task began, ICF subsequently learned that there was little data available or past work on which they could build.
The discovery was not anticipated by ICF as (1) several partly-relevant analyses had been conducted and (2) the existing rules had been implemented for over 5 years. To analyze the regulatory costs and benefits of the cost requirements and implementation rules, ICF needed to address these information and data gaps, which consumed a substantial amount of resources that was not anticipated at the time ICF prepared their cost proposal nor at the time that the NRC developed the statement of work.
After the issuance of SECY-95-223, the EDO withdrew the modified cost-requirements rule, the one on which ICF had been spending most of their efforts, on May 13, 1996. Also, the implementation rule was impacted by the direction of the Executive Director for Operations to publish an Advance Notice of Propowd Ruiemaking.
Because of the change in status of the two rulemakings, and' the amount of funds already expended, NRC issued a stop work order to ICF in April of 1996. Work was then restarted by the NRC in July of 1996 in order to obtain technical assistance in the analysis of public comments on the Advance Notice of Proposed Rulemaking.
WORKSCOPE The contractor shall provide analyses as originally identified in Task 2 as they relate to the implementation rule. These include the changes resulting from the proposed following ar~ ions: reporting requirements, the change in the definition of " utility," c edit for earnings during the safe storage period, and financial assurance t r non-utility reactors that cannot use a financial test.
Further, analyses resulting from the comments on the ANPR, especially as they relate to options to be considered in the regulatory analysis, shall be provided, including the allowance of credit for earnings during the accumulation and outflow periods, the case-by-case approach suggested by several commenters versus a regulatory fix, and a listing to be supplied by the NRC of the comments received on topics not specifically raised in the ANPR.
