NRC STAFF RESPONSE TO BOARD'S MEMORANDUM AND ORDER COMPELLING DISCOVERY ON R0 REM INTERR0GATORIES 17 AND 57 FROM THE NRC STAFF I.
INTRODUCTION On September 4, 1985, Intervenors Bridget Little Rorem, et al.
filed a motion to compel answers to certain interrogatories from Applicant and NRC Staff.
Intervenors sought responses to Interroga-tories 17, 20 and 57 from the Staff.
Staff filed objections and a motion for a protecfive order. On September 27, 1985 the Board ordered Staff to file answefs to Interrogatories 17 and 57 by October 9,1985 and denied the protective order on these interrogatories (" Order"). M The Staff provides the following response to Interrogatories 17 and 57 as limited by the Board's discussion. Order at 9-10.

Interrogatories 17 and 57 Please describe in detail the circumstances and procedures, if any, under which'Ouality Control inspection criteria may be waived.
In what respects are NRC requirements understood to be either minimum or maximum requirements with regard to the design and construc-tion of Braidwood? Please explain in detail and identify any documents which reflect this answer.

NRC Staff's Response The Order limits the Staff's response to "the Braidwood facility and to particular circumstances pertaining to that facility under which quality control criteria or NRC requirements have not been fully applied to the design and construction of Braidwood within the subject areas of the contention." Order at 9.
It is the Board's and the Staff's under-standing that Intervenors wish to determine "whether any of the criteria or requirements that they assert have not been followed will be claimed by Staff not to be applicable to the construction of the facility." M.
The following response by the Staff is limited accordingly.
10C.F.R.Partf50.34requiresthattheApplicanthaveaQA/QCprogram, and Appendix B, to 10 C.F.R. Part 50 establishes the requirements for that program consisting of 18 criteria. The Applicant was required to describe in the Braidwood PSAR and FSAR their commitments to a QA program meeting the requirements of Appendix B.
10C.F.R.50.55(f)(1) requires the implementation of the commitments as described in the Safety Analysis Report (SAR). Once the QA program was accepted by the NRC, changes in the QA program were allowed in accordance with the requirements of 10 C.F.R. 50.55(f)(3). At no time have any changes been made to the Braidwood QA program that waive the requirements of the 18 criteria in Appendix B.
