Cameron [HOME ADDRESS DELETED UNDER 10 CFR 2.790] l SUBJECT: CLOSURE OF INVESTICATIVE FINDINGS (NRC Inspection Report Nos. 50-344/96-05 and 96-07, and NRC Investigation Report No. 4-96-046) Dear Mr. Cameron: l This refers to the subject reports of activities at the Trojan Nuclear Plant. Specifically, the reports discuss an incident in which you violated Trojan's procedures by entering a high ; radiation area without any health physics coverage. You did so in order to investigate the ' possibility that sparks from welding and grinding above might cause a fire. As a result of your action, Portland General Electric (PGE) was cited with a violation dated September 10, 1996. An NRC Office of Investigations investigator interviewed you on October 25 regarding the incident. NRC's Office of Investigations concluded that you deliberately violated Trojan's procedures in deciding whether to take enforcement action against you we considered two important points: (1) that your intentions, although misguided, were motivated by a safety concern (fire), and (2) that you were terminated from employment at the plant. Therefore, the NRC has decided that no enforcement action will be taken against you. While formal enforcement action is not being taken against you, you should be aware that the NRC's regulations allow the issuance of civil sanctions to be taken directly against unlicensed persons who, through their deliberate misconduct, cause a licensee to be in violation of NRC requirements. Deliberate misconduct includes an intentional act or omission that the person knows constitutes a violation of a requirement, procedure or training instruction. An order may also be issued to an individual to prevent his or her engaging in licensed activities at all NRC licensed facilities. A violation of this regulation as set forth in 10 CFR 50.5 " Deliberate Misconduct" (Enclosure 1), may also lead to criminal prosecution. Similar failures in the future could lead to formal NRC enforcement action against you. You are not required to respond to this letter. However, if you choose to provide a response, please provide it to me within 30 days at U.S. Nuclear Regulatory Commission, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011.
