Chen - Nuclear Systems, Inc. has developed a ratchet binder closure system which is proposed as an optional closure method for the primary lid of the CNS
/
8-1200 package. The bolted closure design for this package is presently approved by Certificate of Conferrance No. 9168, Rev 0 dated fiarch 18, 1985.
The description of the ratchet hinder design and analyses performed to demonstrate compliance with applicable parts of 10 CFR 71 are contained in the enclosed Appendix A.
Eight copies each of the proprietary and non-proprietary versions of this Appendix are being submitted to you for review.
Our proprietary affidavit in accordance with 10 CFR 2.790 is enclosed.
Al so enclosed is payment in the amount of $150.00 (one hundred fifty dollars) for the initial application fee in support of this proposed amendment.

The information for which proprietary tmatment is sought is as follows.
Appendix A, Description and Safety Analysis for an Optional Ratchet Binder Closure System for the CNS 8-120B Shipping Package.
This document has been appropriately designated as proprietary.
I have personal knowledge of the criteria and procedures authorized by CNSI in designating information as a trade secret or as privlaged/ confidential i
information of a comericial or financial nature.
Pursuant to the provisions of Paragraph (b) (4) of Section 2.790 of the Comission's regulation, the following is furnished for consideration by the Comission in determining whether the information sought to be withheld from public di sclosure, included in the above referenced documents, should be wi thheld.
1.
The information sought to be withheld from public disclosure is a design description and Safety Analysis of a cask closure system, which is owned and held in confidence by CNSI, and not disclosed to any third party without first obtaining that party's written agreement to hold the information in confidence.
2.
The ownership of this information results in a substantial economic advantage to CNSI, over its competitors who do not know or use it.
3.
The information is of a type customarily held in confidence by CNSI and not customarily disclosed to the public.
CNSI has a rational basis for determining the type of information to be held in confidence.

The information is being transmitted to the Comission under the provisions of 10CFR2.790 with the understanding that it is to be received and held in confidence by the Comission.
5.
The information, to the best of my knowledge and belief, is not available in public sources, and any disclosure to third parties has been made pursuant to regulatory provisions or proprietary agreements which provide for continuing the confidentiality of the information and only to those parties who need to know the information.
6.
Public disclosure of the information is likely to cause substantial harm to the competitive posi tion of CNSI because development of this information by CNSI required hundreds of man hours of effort and tens of thousands of dollars.
To the best of niy knowl edge and belief other parties including competitors would have to undergo similar expense in generating equivalent information.
Public disclosure of the information would enable a competitor to avoid the effort and expense to develop this information and would enable that competitor to develop a similar product at a significant cost savings, thereby imp < f ring the ti.tive position of CNSI.
