Dear Mr. Sellman:

This letter acknowledges receipt of your letter dated September 25,1996, which transmitted changes to the Security Training and Qualification Plan for the Waterford 3 Steam Electric Station submitted under the provisions of 10 CFR 50.54(p).

Based on your determination that the changes do not decrease the overall effectiveness of your security plan and after limited review of the changes, no NRC approvalis required for some of the changes, in accordance with 50.54(p). Implementation of these changes will be subject to inspection to confirm that the changes have not decreased the overall effectiveness of your security plan.

However, some changes appear to be inconsistent with the criteria of 10 CFR 50.54(p) or involve policy issues and are being referred to our Office of Nuclear Reactor Regulation.

The changes are identified in the enclosure to this letter.

The enclosure to your letter contains proprietary information as specified in 10 CFR 2.790(d)(1) and is being withheld from public disclosure. In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter, without your enclosure, will be placed in the NRC Public Document Room.

TRAINING AND QUAllFICATION PLAN PROPOSED CHANGE:

Item 8 of the licensee's 10 CFR 50.54(p) change to their security training and qualification plan indicated that they have: (1) deleted the handgun qualification course of fire from the plan and stated that the course of fire is described in the security implementing procedure detailing the Security Force Training Program and (2) removed the specific amounts of ammunition available for each weapon and the amounts of ammunition stored on cite for i

each weapon and describes these amounts in security implementing procedures.

REGULATORY REQUIREMENTS:

10 CFR Part 73.55, paragraph (b)(4)(ii) states, "Each licensee shall establish, maintain, and follow an NRC-approved training and qualification plan outlining the processes by which guards, watchmen, armed response persons, and other members of the security organization will be selected, trained, equipped, tested, and qualified to ensure that these individuals meet the requirements of this paragraph.

10 CFR 73.55, paragraph (b)(3)(i) states, in part, that written security procedures document the structure of the security organization and detail the duties of guards, watchmen, and other individuals responsible for security.

10 CFR 73, Appendix B, Section V.A.4.(b) requires the licensee to maintain ammunition available on site at two (2) times the amount required in Section V.A.4(a) of Appendix B for each type of weapon.

GL 95-08, titled: "10 CFR 50.54(p) Process For Changes To Security Plans Without Prior Approval," states, that a change made pursuant to 10 CFR 50-54(p) cannot delete or replace any of the regulatory capabilities as described in paragraphs (b) through (h) of 10 CFR 73.55 or Appendixes B and C of 10 CFR Part 73.

Conclusions:==

A licensee can change security implementing procedures without NRC review or approval. Therefore, (1) licensee weapons training courses can be changed to any course the licensee desires, including no live firing of weapons at all and (2) ammunition may not be maintained at the required inventory.

These changes appeared to be a decrease in the NRC approved Security Training and Qualification Plan and are being referred to the Office of Nuclear Reactor Regulation, for further resolution.
