Dear Mr. Bailey:

! This letter addresses the issue of continued funding of training and travel for State of i

California staff conducting work under the Section 274b Agreement with the Nuclear Regulatory Commission (NRC). Your letter of November 6,1996 requests that NRC i continue to fund reasonable training and travel expenses through June 30,1997. You asked to be informed of the steps necessary to receive NRC funding support. Dennis Sollenberger discussed this information with you by telephone on December 18,1996.

While we recognize the need for training and your current funding shortfall, the

! Commission, in SECY-95-017, specified the conditions under which the staff could continue

! funding for certain Agreement States. The situation in California, as you have described it, l does not meet the . conditions _ approved by the Commission. Therefore, NRC will not be able l to continue to fund training and travel for your-staff through June 30,1997, as requested.

! Please note, however, by fax note from Paul Lohaus, Deputy Director, Office of State

Programs, dated November 8,1996, the Radiation Control Program Directors were notified j that the Commission has approved Agree'ment State personnel attendance at NRC training

! courses.without ' charge; on a space available basis, consistent with the Commission's

j preliminary views on Direction Setting issue #4, "NRC's Relationship with Agreement l States." Agreement States are responsible for travel and per diem expenses associated with

! course attendance. -

i We appreciate th^e suggestion'of moving certain courses around the country to reduce travel i expenses. This has' been done in'the past and we will consider it in the future when need is j identified for a specific State or region. We will work with the Technical Training Division to assess whether this might be feasable for future fiscal years.
