Dear Ms. Jeffs:

I am responding to your November 14, 1996 letter on reciprocity / jurisdiction.

Earlier this year the enclosed standard license condition, for use on Nuclear Regulatory Commission (NRC) temporary jobsite licenses, was sent to the Regional licensing programs for review and comment along with proposed revisions to the procedures and guidance concerning' reciprocity. This action was taken in conjunction with the development of a rulemaking plan proposing minor revisions to 10 CFR 150.20, " Recognition of Agreement State licenses" which addresses reciprocity and the recognition of Agreement State licenses.

Staff is currently incorporating the comments received into the procedures and guidance, to include the new standard license condition, for final issue to the Regional licensing programs.

ENCLOSURE Proposed License Condition for NRC Licensees to Include on Temocrary Job Site Licenses Radioactive material shall be used only at the following:

A. 2345 High Water Avenue, City, State ,

i B. Temporary job sites anywhere in the United States where the U.S.

Nuclear Regulatory Commission maintains jurisdiction for regulating licensed material including areas of exclusive Federal jurisdiction within Agreement States.

If the jurisdictional status of a Federal facility within an Agreement State is unknown, the Federal agency controlling the job site in question should be contacted to determine whether the proposed job site is in an area of exclusive Federal jurisdiction. Authorization for use of radioactive materials at job sites in Agreement States not under exclusive Federal jurisdiction shall be obtained from the appropriate State regulatory agency.
