Sequoyah Nuclear Plant Docket No. 50-328 l Sub.iect: PROPOSED IMPOSITION OF CIVIL PENALTIES - $100,000 i This is to inform the Commission that a Notice of Violation and Proposed i Imposition of Civil Penalties in the amount of $100.000 will be issued, on or l about December 24, 1996, to the Tennessee Valley Authority (TVA). The action j involves two Severity Level III problems at the Secuoyah Plant. Unit 2, l

related to
(1) failure to implement effective anc/or timely corrective i l actions resulting in poor plant material condition that caused and complicated l recovery from a plant trip: (2) a breakdown in the control of licensed l activities involving failures in Operations, Maintenance, and Engineering

! activities related to replacement of an inoperable reactor trip breaker. ,

In accordance with the Enforcement Policy, a base civil Jenalty in the amount of $50,000 is considered for each Severity Level III pro)lem. TVA was not given credit for identification of either problem because: (1) the first problem was revealed through an event and the licensee had reasonable indications of the potential problem and did not take prompt actions, and (2) NRC prompted review of several aspects of the underlying issues involved in the second problem. The licensee was given credit for the factor of corrective action for both problems because once identified, corrective 1 actions were prompt and comprehensive. Consideration of these factors l resulted in a base civil penalty of $50,000 being proposed for each problem or

total civil penalties of $100.000 for the action.

It should be noted that the licensee has not been specifically informed of the i enforcement action. The schedule of issuance and notification is: I Mailing of Notice December 24, 1996 Telephone Notification of Licensee December 24, 1996 The State of Tennessee will be notified.

The licensee has thirty days from the date of the Notice in which to respond. 1 Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
