SUBJECT: NRC INSPECTION REPORT 50-440/96006 AND NOTICE OF VIOLATION

Dear Mr. Myers:

On September 14,1996, the NRC completed a routine safety inspection at your Perry 1

reactor facility. The enclosed report presents the results of that inspection.

During the 7-week inspection period there were no plant transients; however the operators

did reduce plant power to 60 percent in an unsuccessful attempt to locate a condenser

tube leak. Plant operators also responded to indications of a broken electricallug which

had the potential to require a plant shutdown. The operations staff and support

organizations responded well to both situations.

We are concerned about two violations of NRC requirements that were identified. In the

first case, the inspectors identified two examples of failures of personnel to follow

procedures. Although these examples had no rarety consequences, we are concerned

because your past corrective actions for similar violations did not prevent the current

examples. We are concerned about the second violation, a missed surveillance, because

of the importance of idsntifying the proper scope of surveillance testing to insure that

reliability of safety-rslated equipment is maintained.

The violations are cited in the enclosed Notice of Violation, and the circumstances

surrounding the violations are described in detail in the enclosed report. Please note that

you are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. The NRC will use your response, in part,

to determine whether further enforcement action is necessary to ensure compliance with

regulatory requirements.
