SUBJECT: NRC INSPECTION REPORT 50-285/96-17

Dear Mr. Gambhir:

l

On December 20,1996, the NRC completed a special inspection at your Fort Calhoun

Station reactor facility. The purpose of the inspection was to follow up on the inoperability

of the postaccident sampling system from February 1996 to July 1996. The enclosed

report presents the results of that inspection.

Based on the results of this inspection, five apparent violations were identified and are

being considered for escalated enforcement action in accordance with the General

Statement of Policy and Procedure for NRC Enforcement Actions" (Enforcement Policy),

NUREG-1600. The first apparent violation involved a failure to cancel a preventive

maintenance order which could no longer be parformed as required by Technical Specification 5.15. The second apparent violation involved removing a portion of the

postaccident sampling system prior to issuance of an engineering change notice. This was

contrary to your configuration control process. The third apparent violation involved not

properly prioritizing maintenance work on the postaccident sampling system as required by

Technical Specification 5.15. The fourth apparent violation involved the inability to sarnole

or monitor the containment atmosphere from February 1996 to July 1996 as required by

Technical Specification 5.15. The fifth apparent violation involved a failure to follow

procedures as required by Technical Specification 5.15 in closing out a preventive

maintenance task. The circumstances surrounding these apparent violations were

discussed with members of your staff at an inspection exit meeting on December 6,1996.

Following the exit you presented additional information regarding your capability to sample

the containment atmosphere using the postaccident sampling system. The inspectors

discussed this additional information with NRC management and a decision was made to

re-open the inspection. On December 16, the inspectors met with you and requested that

all addition *' nformation be provided. The inspectors reviewed this information and on

A predecisional enforcement conference to discuss these apparent violations has been

scheduled for January 29,1997. The decision to hold a predecisional enforcement

conference does not mean that the NRC has determined that a violation has occurred or

that enforcement action will be taken. This conference is being held to obtain information

to enable the NRC to make an enforcement decision, such as a common understanding of

the facts, root causes, missed opportunities to identify the apparent violations sooner,

corrective actions, significance of the issues and the need for lasting and effective

i

corrective action, in addition, this is an opportunity for.you to point out any errors in our

inspection report and for you to provide any information concerning your perspectives on

'

(1) the severity of the violations, (2) the application of the factors that the NRC considers

when it determines the amount of a civil penalty that may be assessod in accordance with

Section VI.B.2 of the Enforcement Policy, and (3) any other application of the Enforcement

Policy to this case, including the exercise of discretion in accordance with Section Vll. In

accordance with a revision to the Enforcement Policy published in the Federal Register on

December 10,1996, the conference will be open to public observation, but not

You will be advised by separate correspondence of the results of our deliberations on this

matter. No response regarding these apparent violations is required at this time.
