URANIUM MILL TAILINGS TASK FORCE 21 DEC 83 j_: 47 h
In your memorandum of October 12, 1982 you requested that the staff revisit the matter of NRC's uranium mill tailings regulations.
Lead responsibility for this task was assigned to the Division of Fuel Cycle and Material Safety, Office of Nuclear Material Safety and Safeguards.
A task force was appointed to take a fresh look at the regulations and consider options for change if any were indicated. The task force con-ducted a reassessment of the health and safety issues related to mill l
tailings which included consideration of a risk-based approach to health and safety objectives using International Commission on Radiological Protection methodology. The task force reassessment focused on radon i
l control and embodied a " fresh look alternative" to existing NRC and the l

. pr:sposed Invironmental Protection Agency (EPA) rules. The -task force l

Commission Paper were the staff comments on the proposed EPA rules and recommendations were documented in the SECY-83-195.
Included in that the supporting Radiological Analysis of Mill Tailings Requirements which provided the principal radiological basis for the letter, approved by I
the Commission, in which the staff commented on the proposed EPA rules.

The final EPA standards were promulgated on September 30, 1983. The l
I fundamental approach to radon control adopted by EPA is similar to that in previous NRC regulations rather than to the alternative approach recommended by the staff in its comment letter to EPA. However, the numerical value for radon release has been changed from 2 to 20 pico-curies per square meter per second. The staff is now submitting plans to the Commission for revising the NRC mill tailings regulations to conform to the final EPA standards. This conforming rulemaking will be accomplished by Division of Waste Management staff. Unless the Commission decides to propose rules that differ substantially from the

same way as they are used in other licensing actions.
Branch technical positions are used to identify, both to the applicant and to the staff, what is known to be acceptable to the staff with regard to a specific licensing issue. The staff is now preparing to conform our regulations to the final EPA standards. Upon completion of this conforming rulemaking, the Division

Office of Region IV, plans to review and revise, as necessary, all branch l
technical positions and regulatory guides that may be affected by the final EPA standards and the conforming regulations.
